Mar 14, 1750[/1] from William Boarman of CC, to Sara Hanson & Smith Middleton of CC, the lease of a certain parcel of land or tenement whereon John Garratt now lives, bounded by the north side of the late Vincent Askins Mill Run, the road that goes from sd Garratt's house to the Bridges, thence to Francis Montgomery's land, Boling Speak's land, Sarah Hagan's path that leads to Benedict Road, thence with sd road to Wm Bryan's land. This is a 13 year lease, starting Feb 18 last. The yearly rent is 12 £ for the first 11 years, and for the other 2 succeeding years 15 £ Hanson & Middleton may have any of Boarman's timber on Unleased land for buildings or repairs. Instrument of Writing, I, Francis Montgomery of CC, owe Samuel Hanson of CC, 6362 lbs of crop tobacco in hhds, and wanting to make him what satisfaction I can for the same, I hereby transfer to him the following: 3 cows marked with 2 swallow forks & under bit in each ear, 2 heifers, 3 yearlings, 11 hogs and shoats all marked with the same mark, 3 mares, 1 colt, 1 young horse, 1 of the mares branded with a hook, the other branded WB, the other mare branded DMD & the younger horse branded; 2 feather beds furniture and 1 old bed, 3 iron pots, 1 frying pan, 2 broad axes, 2 handsaws, adges, and the rest of my joiners carpenters tools, and the increase of the females afd, all of which will be appraised, but no part will he at Hanson's risk until it is appraised and by Hanson taken out of the possession of Montgomery, and will henceforth be the property of Hanson. If the several articles afd should be appraised to more than the debt afd, then Hanson will pay Montgomery, and if the articles are appraised at less than the debt, the balance must be paid by Montgomery. Feb 8, 1758 from James Middleton and Sarah, his wife, of CC, to Smith Middleton and Ignatious Middleton, their sons, for the natural love they have for their sd sons and for divers other good causes, to wit, 100 £ sterling, part of a tract of land in CC and now in possession of sd James and Sarah, called Jordan. That is to say, to sd Ignatius, his part thereof (after the death of sd James and Sarah) beginning on Jordan Branch [Swamp] where the old Coach Road crosses the sd Branch, which is the Road that comes from the new bridges to John Smith of Jordan plantation where he now lives, so up with the small branch that runs through the corn field, to the head of the sd branch & then with a west course to the Mill branch, then with sd mill branch to the west side till it comes to the road that goes from the new bridges to Edward Jenkins & so with sd road till it comes to the back line, then with sd line to Samuel Baggett's line, so with sd line to Jordan branch, then with sd branch to the beginning. And sd Smith Middleton, all the rest of their part of sd tract of land. Whereas sd James and Sarah intend, by these presents, that each of their sd sons shall have as near as may be, an equal part of sd land, if it happens that the courses mentioned, if Ignatious' part fall short or exceed more than one half, whoever has the larger part, the overplus is to be valued by two honest men, one to be appointed by each son, & one half the value is to be paid by our son who has the larger part to the son with the smaller part. May 26, 1788 from Smith Middleton of CC, planter, to Francis Tolson of Prince George's County, planter, for 5 £ sundry Negroes, to wit, a woman named Cate, a child named Jacob, a child named George, a girl named Minte, a child named Roger, a man named Frank. If, however, sd Smith Middleton pays to Grace Lee of CC, 106 £ 6 shillings half penny and the further sum of 22 £ 3 shillings and 11 pence, the conditional sums of 2 bonds entered into by the sd Smith Middleton and the sd Francis Tolson as security to the sd Smith Middleton to the sd Grace Lee, dated May 26, 1788, and shall exonerate and save harmless the sd Francis Tolson from sd sums as security in the sd bonds to the sd Grace Lee, then these presents shall cease. Charles County Land Records 1790-1792; Liber K#4; Page 273. Deed of Trust. Dec 6, 1790 from Smith Middleton of CC, to Thomas Andrew Dyson, Esq, Sheriff of CC. Sd Middleton, by his petition to the General Assembly of Maryland, set forth that he was confined in CC Jail for debt, and that by reason of many misfortunes, he was unable wholly to satisfy his creditors, and prayed, in his petition, that a law might pass to discharge him from further confinement, upon his delivering up all his property for the use of his creditors. Sd General Assembly, at Nov session 1790, passed an act declaring that, if sd Middleton complies with ad act, he shall forever thereafter be released from all debts, promises, contracts, and covenants due from him, and appointed the CC Sheriff as the Trustee in behalf of the creditors of sd Middleton. Now this deed witnesses that Smith Middleton, for the premises afd and other good causes, sells to Thomas Andrew Dyson, CC Sheriff, the following property, to wit, all the wearing apparel of Smith Middleton, kitchen furniture, 1 large case and bottles, 1 small case and bottles, 1 copper kettle, 2 iron tea kettles, 1 bellmettle skillet, 1 old spice mortar and pestle, 1 bed and bedstead, 1 cow and calf, 1 old warming pan, 1 tea chest, 1 spinning wheel, 1 pair of wool cards, 1 pair of old cotton cards, 1 pair of spoon molds, 1 old mare and colt, some stone jugs and butter pots, some quart bottles, plantation utensils, 1 old Cart, 1 old gun, 1 pair of tongs, 1 shovel, 2 pair of andirons, 1 tin sugar box, 2 chamber pots, 1 old cruet stands, a parcel of china and glass ware, 2 small bear casks, 1 old silver watch, some lumber, 1 hair sieve, and 1 gauze sieve, in trust for the use of all the creditors of Smith Middleton.
