Westmoreland County Court 28th of August 1706
- EARLE v RUST, &c.
SAMUELL EARLE by his Petition to the Worshipfull Court for this County setting forth that SAMUELL EARLE, his Father, died possessed of a considerable personall Estate &c., And that MATTILDA, his Widdow, possessed herself ofthe same by administering thereon, and before any Inventory thereof returned, intermarried with WILLIAM RUST by whhich meanes hee the sd RUST became possessed thereof, that the sd RUST then also being dead, his Sons & Executors, SAMUELL and GEORGE RUST, together with MATTILDA as his Widdow, were possessed ofthe same and refused to deliver him his fillial part thereof. Therefore prayed a citation &c. upon which it was ordered severall persons to audit state and settle all accounts and matters in difference betwixt the Estates of EARLE and RUST aforesd and make report to this Court And now at this Court upon return ofthe audit aforesd it appeareing that the Estate of SAMUELL EARLE, the Father, by appraisment was valued at eight thousand four hundred ninety three pounds of tobacco and that the sd RUST had by lawfull and just payments disbursed on account of the sd EARLE's Estate the sume of five thousand three hundred seventy three pounds oftobacco which with five hundred thirty seven pounds of tobacco the sallary thereof at ten percent amounting to five thousand three hundred tenn pounds oftobacco being deducted out ofthe same of the appraisment there rests in the hands ofthe Executors ofthe sd RUST two thousand five hundred eighty three pounds oftobacco which it is ordered the sd SAMUELL RUST and GEORGE RUST in their qualification aforesd or one of them doe pay to SAMUELL EARLE or order with costs &c. als execution; And whereas it appeares there is still further due from the Estate ofthe sd. SAMUELL EARLE, deceased, to one WILLIAM SANDERS the sume oftwelve hundred pounds oftobacco, the same being deducted out of the above ballance there rests one thousand three hundred eighty three pounds oftoacco out ofwhich it is ordered the sd SAMUELL EARLE doe pay the sum oftwo hundred seventy six and three fifths of a pound of tobacco being the fifth part ofthe sd surne of one thousand three hundred eighty three pounds of tobacco

WILLIAM BUTLER in right ofhis Wife, SCICILA, by his Petition setting forth that SAMUEL EARLE, who became security with EDWARD BERRY [who intermarryed the Relict of JOHN CRITCHER, deced], for EDWARD BERRY's administration of JOHN CRITCHER's Estate, refused and denyed to render and pay to him in behalfe of his the said BUTLER's Wife, the Estate which of right did belong to her out of JOHN CRITCHER's Estate as being one of the Orphants of JOHN CRITCHER, which WILLIAM BUTLER prayed the Court's Judgment; Upon heareing thereupon the Court with the consent and good likeing of the Pltf and Defendt. doe referr the same to the Auditt and determination of GEORGE ESKRIDGE Gent., Mr. JOHN GARNER and Mr. SAMUEL RUST, whoe are requested to settle and decide the difference and return an Account thereof to the next Court to be held for this County

THIS INDENTURE made the fourteenth day of December in the Eleventh year of the Reign of our Sovereign Lord George the Second by the grace of God of Great Brittain France and Ireland, King, Defender of the faith &c., And in the year of our Lord God one thousand seven hundred thirty and seven; Between SAMUEL EARLE the Elder of Cople Parish and Westmorland County of one part and JAMES THOMAS JUNIOR of the same Parish and County of other part; Witnesseth that said SAMUEL EARLE in consideration of the sum of Five pounds current money of Virginia to him in hand paid by JAMES THOMAS JUNIOR, the receipt whereof SAMUEL EARLE doth hereby acknowledge himself fully satisfied and paid, hath and by these presents doth bargain and sell unto JAMES THOMAS JUNIOR his heirs all that parcel of land containing by estimation Eleven acres being part of a Patient for One thousand acres of Land formerly granted unto JOHN EARLE, Grandfather of said SAMUEL EARLE, party to these presents, scituate in the aforesaid Parish and County and bounded; Begining at two marked Hickorys and a Dogwood by an old marked red Oak, corner to the Land of JAMES THOMAS SENIOR, and on West side of a Branch that fans into JAMES COURTNEYs Mill Pond and extending thence down the Branch and binding with the Land of JOSEPH CARR South sixty one degrees East thirteen poles, South seventy four degrees East fifteen poles, South fifty four degrees East thirty poles, South thirty three and a half degrees, EL ten poles to two small Ash trees at the mouth of another small Branch, thence up the small Branch and binding on the water course thereof South fifty three degrees West ten poles, North eighty degrees West Eight poles, South sixty six degrees West thirty poles, South fifty one degrees West thirteen poles to a Gum in the line of said JAMES THOMAS, SENIOR, thence along his line North sixty three poles to the begining; with all rights members and appurtenances houses orchards and commodities belonging; To have and to hold the premises with appurtenances unto JAMES THOMAS, JUNIOR, his heirs; and SAMUEL EARLE for himself his heirs the premises hereby sold unto JAMES THOMAS, JUNIOR his heirs against the claim of any person shall warrant and for ever defend by these presents; In Witness whereof the parties to these presents hath interchangeably set their hands and seals the day and year first above written

Memorandum; That on the fifteenth day of December in the year of our Lord one thousand seven hundred thirty seven SAMUEL EARLE made Livery and Seizin of the within granted lands and appurtenances unto JAMES THOMAS, JUNIOR, by delivering him Turff and Twigg and the Ring of the Door of the Mansion House on the lands in the name of the whole lands and appurtenances within mentioned; And that MARY PUPSLEY, Tenant thereon allowed and became Tenant to said JAMES THOMAS, JUNIOR
