South Park Greenies not out of the fight

The attorney representing supporters of renovating the former South Park High School building rather than demolishing it says the school district is assuming it has the right to tear down the structure with non-bond money once a judge's order is completed.

Attorney Michael Getz, who represents the Beaumont heritage society and Eddie Estillett, says an order by 58th District Judge Bob Wortham will issue a permanent injunction against BISD preventing the use of money from a 2007 bond election to tear down the school, but does not clear the way for BISD to do so with other funds.

"We are not to the point where they have authorized other funds to be used to tear down the building." Said Getz. He went on to say he would be watching BISD and the school board's actions to determine what actions he will take next.

Getz is writing the order to be presented to Judge Wortham for final approval. He says it is customary for the winning side in a lawsuit to undertake the writing of the actual order. The other side will have a right to review the ruling before the Judge signs the order.

Once signed, the final judgment will turn the previously announced oral rendition of the order into a final order of the court. Once that happens, anyone wishing to file an appeal.

Getz says he expects to turn in his order by sometime next week at the latest.
