8/13 BISD Appeals Judge's Ruling

The attorney for the Beaumont Independent School District is appealing a judge's decision on South Park Middle School.

Melody Chappell tells Fox 4 News filed the appeal Thursday. This comes just three days after the school board voted to appeal Judge Bob Wortham's ruling.

The Beaumont Historical Society sued the district to keep it from demolishing South Park. The demolition was part of a 2007 bond proposal passed by voters.

Judge Wortham granted a *permanent injunction earlier this month, banning the district from tearing down South Park.

Wortham says a pamphlet published by the Beaumont Chamber of Commerce misled voters by making them think South Park would survive, if the bond passed.

Chappell says the district is appealing on the basis that only the board can bind the district. She says a pamphlet nor the Chamber can legally bind the district.

Chappell goes on to say that even if someone from the district provided information for the bond, it wouldn't matter, because it was officially done by the school board.
