    Other Events and Attributes:

    • Will: 5 Nov 1776, Charles Co, Maryland

    Notes:

John Stone, son of Matthew and Rachel (Smoot) Stone, was born at "Poynton Manor", Durham Parish, Charles County, Maryland. In court during 1769, he declared himself to be 55 years of age and mentioned his father Matthew Stone, then deceased. He married twice, but the name of his first wife has not been established.

Children of John Stone by First Marriage
    1. Thomas Stone married Catherine (???). q.v.
    2. Josiah Stone, d.s.p. Somerset Co., Md., 1781, willing dwelling-plantation, "Drury Lane", to brother John.
    3. William Stone married Betsy Murray. q.v.
    4. John Stone, d.s.p. 1783, willing "Drury Lane" to brother Thomas, "that which was willed me by brother Josiah", also named his brother William and the latter's wife, Betsy, and his brother-in-law, Jeremiah Gray. Inventory signed by Mary Gray and William Stone.
    5. Mary Stone married Jeremiah Gray.

By 1763 John Stone had become a widower and had married Mary, the daughter of Barton Warren, but then the widow and administratrix of Harrison Musgrove. On June 6, 1758, she, then being Mrs. Mary Musgrove, shared in the distribution of her father's estate. On April 29, 1760, she was granted letters of administration on the estate of her deceased husband, Harrison Musgrove, with Notley Warren and John Warren offering bond. The final settlement was made by her on May 15, 1762, as Mary Musgrove, and showed distribution to her and unnamed children.

Children of John and Mary (Warren) Stone
    6. Matthew Stone married Jane (???).
    7. Warren Stone.
    8. Elizabeth Stone.
    9. Barton Warren Stone married twice. q.v.

John Stone negotiated his will on August 6, 1775, and appointed his wife, Mary, as the executrix. He named the following children--Thomas, Josias, William, John, Matthew, Warren, Elizabeth, and Barton; and grandson John Stone Gray. The instrument was admitted to probate in Charles County on September 12, 1775, by Samuel Stone, Elizabeth Stone, and Theophilus Hanson.

The inventory of his personal estate was taken on May 31, 1776, with Mary Stone and Josiah Stone as the executors, and Barton Stone and Samuel Stone as the kinsmen.

His estate was distributed on November 5, 1776, to the widow, and the following representatives--William Stone, Josiah Stone, John Stone, Matthew Stone, Warren Stone, Elizabeth Stone, Barton Stone, and John Gray. The sureties for the executors were Thomas Stone and Edward Warren.

Before 1778 his widow with her Stone children either joined
or settled with her Musgrove children in Pittsylvania County, Virginia, then an undeveloped and outpost county of that State.

At the December term of court in 1778, Thomas Stone "one of the surviving administrators" of John Stone offered a petition setting forth the fact that the decease's estate was then in the hands of Mary Stone and Josias Stone and that most of it had been wasted or removed out of the State and that he "is in danger of suffering in the responsibility", and therefore the court ordered that the other executors be summoned to the next court. On February 12, 1779, Benjamin Philphott and Thomas Harris gave bond for Mary Stone, widow, and Josias Stone, executors of John Stone.

lands of the said Matthew Stone and William Stone. On May 13, 1747, he conveyed for the consideration of natural love and affections which he held for his son Thomas "Jr.", a portion of "Poynton Manor", adjoining the lands of Matthew Stone, Thomas Matthews, and Barton Stone. Rachel Stone, his wife, acknowledged the deed and waived dower.

Matthew Stone dated his will November 7, 1748, at which time he appointed his sons Barton and Thomas as the executors. Rachel his wife was devised the dwelling-plantation during life then equally to his sons Samuel and William. His daughters Anne and Elizabeth were bequeathed various personalty, while Mr. Porteus was appointed the guardian of his young son William. The will was admitted to probate in Charles County on August 10, 1750, and proved by William Hanson, Mary Hanson, and John Jenkins.

Rachel Stone, however, was appointed executrix and certified to the inventory on November 3, 1750, with John Stone and Barton Stone as the kinsmen. Gustavus Brown and Walter Brown were the greatest creditors.

The final statement was rendered to the court on September 14, 1751, when the proceeds were distributed among the widow and the following heirs--Samuel Stone, William Stone, Elizabeth Stone, and Anne Stone. David Stone and John Stone were bondsmen for the widow and executrix.

The will of his widow was dated September 8, 1756, and admitted to probate in Charles County on November 6, 1758, by Maximillan Matthews, John B. Meek, and Jesse Douglas. She appointed her sons, Samuel and William, as executors, and named her daughter, Elizabeth Stone.

On January 15, 1759, an inventory of her personal estate was made with John Stone and Barton Stone as the kinsmen, and Samuel Stone and William Stone, as the executors.

Know that you, not being any way related to the Petitioner, contiguous Proprietor, nor interested in the sd land, power to examine witnesses which shall be nominated to you by the afd petitioner or other concerned person Signed Nov 15, 1728 [sic] - Saml Hanson, Clerk.
We certify the several depositions hereunto annexed. Signed Feb 14, 1728 - Robt: Hanson, John King, Absalom Thorne.

Henry Tanner, age about 89, declares that about 30 years ago, he lived on the Plantation now in the possession of Thomas Stone, and that then Nicholas Bead showed him a bounded white oak standing near the brink of Nanjemy Cr by an old Gravelly Landing, which tree is now fallen in a small marsh near a crooked locust, which oak this deponent declares the sd Nicholas Bead told him was the bounded tree between the land of Mr: Stone and Mr: Gerrard Fowke, and that Mr: John Stone afterwards told this deponent that Nicholas Bead had showed him the right bounded tree. Signed - Henry Tanner. Feb 14, 1728.

William Davis, age about 70, declares that about 40 years past, he remembers a bounded white oak which stood very near the place mentioned in Henry Tanner's deposition, which John Hanson told him was the dividing tree between the lands of Mr: Stone and Mr: Gerrard Fowke. Signed - Wm Das. Feb 14, 1728.

Mathew Stone, age about 49, declares that the reputed bound tree (a white oak) between the lands of Mr: Stone & Mr: Gerrard Fowke, stood on the brink of Nanjemy Cr, near which place now stands a forked white oak sapling with a hammock of grape vines on the top, about 32 yards down the Cr from the place mentioned in Henry Tanner's deposition. Signed - Mathew Stone. Feb 14, 1728.

Priscilla Davis, about age 60, declares that a bounded white oak with a forked and bending top, stood between the place mentioned in Mathew Stone's deposition and the end of Stone's fence near Nanjemy Cr side, which this deponent has heard was the bound tree between the lands of Mr: Stone & Mr: Gerrard Fowke, according to the best of her knowledge. Signed - Priscilla (P her mark) Davis.

Edward Milstead, age about 70, declares that 40 odd years ago, Dr. Maddox showed him a bounded white oak standing at the end of a point near a marsh, and told this deponent that it was a dividing tree between his land and the land of Mr: John Stone, which tree is now standing but dead, at the root of which tree is a large stone with the letters GF cut thereon, which tree, this deponent says, he believes to be the tree which the sd Maddox showed him. Signed - Edward (E his mark) Millsted.
