- John McCall married Martha Garner Jan 1869 months before this census; so curious she is not counted here. Mary, age 6, and Alzina Hayes, 12, living in his household, are children of Martha's uncle James Hayes, Jr. (her mother's brother). Their mother, Emily Burrell Hayes, died previous to this census and relatives took in the young children. Another Hayes child, Nancy, 8 yrs old, was taken in by Jamss McCall.
Jacob Garner took in Matilda, 10 yrs old (my ancestor).
Marie Johnson, living with John McCall, is James Hayes, Jr.'s mother. After J.H. Sr. died, she married Francis Gallier, Jr - who had also passed by this time.

- For a long time, I believed that Garner died of pneumonia due to much exposure to the winds and rain (from intense hurricane on Oct 12, 1886) but Bill Quick has determined that Garner lived on for about four months months after the storm, and that his actual death date was February 27, 1887.

"Jacob Harmon Garner, 1814 to 1887. Louisiana native, son of Bradley and Sarah Harmon Garner, settled in Jefferson, a village on Cow Bayou in present-day Orange County, Texas in 1825. In 1835 he took part in the Grass fight and siege of Bexar while serving one of two enlistments in the Texas Army for which he later received land and bounty grants. Veteran Capt. D. Garner's Co. Battle of San Antonio December 1835. Near San Jacinto in Capt. Patterson's Co. April 21, 1936. He married Matilda Hayes in 1838. A prominent citizen of Jefferson County. He served as Jefferson County Justice of the Peace in 1843. District Clerk from 1846 to 1850, Sabine Pass Alderman in 1857, and as a third Lieutenant in the Confederate Army in 1861. Sesquiqentennial of Texas statehood 1845-1995."

- Jacob H Garner applied and was appointed Guardianship of Amelia "Milly" (Hayes) Benjamin Myers' children by the Court at Beaumont. Don't have exact date, but new appraisers were appointed Nov 29, 1847; so previous to that. He was listed as a principal with Thos H Lewis & John B (x his mark) Pevito security.
1880: Jacob Garner age 66 states parents born in VA. Also listed with them are Rachel, age 14, and Othneil, age 4, goddaughters.
(Yellowed Pages show marriage date of 13 June 1843) He was the son of Bradley Isaac GARNER SR, and Rachel HARMON, born in 1814. Jacob's sister was Rachel Garner who married Benjamin Johnson.
BRADLEY ISAAC GARNER, SR., came to Tx, from Louisiana, in 1828 (1850 Census) According to First Settlers of Jefferson Co, Texas by Gifford White, Land Grants in Texas: 130th Applicant: Bradley Garner took and Subscribed to the oath requiredy the 12th Secretary of Land Law that he emigrated to Texas in 1829. It was proven that he was a citizen of Texas at the date of the Declaration of Independence by the oath of Richard Ballew and Wilson W. Gill.
David Garner was possibly Bradley's brother, even though there were 12 years difference in their ages. David GARNER married Matilda Hampshire in 1839 in Jefferson Co, and their children were Emily, born 1840; Jacob, born 1841; David G, born 3; Clairborne, born 1844; Anna, born 1845; Martha, born 1847; John, born 1848; and Alexander, born 1850.
Listed in First Settlers of Jefferson Co, Texas by Gifford White, Land Grants in Texas 47th Applicant: JACOB GARNER took and Subscribed to the oath required by the 12th Secretary of Land Law that he emigrated to Texas in 1829. It was provhat he was a citizen of Texas at the date of the Declaration of Independence by the oath of Clairborn West and BRADLEY GARNER.
The census states Jacob had come to Texas in 1825 (age 11) with David Garner (born in 1807; i.e. 18 years old). Land Grant records state Bradley came in 1828 and Jacob swore he emigrated in 1829, witnessed by Bradley.

- After returning home to his father's cabin on Cow Bayou, now in Orange County, Jacob Garner next appeared in recorded history as a freeholder, subject to jury duty, in Jefferson County in January, 1837.22 On November 29, 1838, Jacob H. Garner married Matilda Hayes (b. January 13, 1817-d. May 14, 1895) at Beaumont, the 25th marriage license issued in the county courthouse records.(23) She was the daughter of James Hayes, a native of Virginia, and Augusta Matilda Smith, who were married in the Catholic Church, Parish of St. Landry, Military Post of Opelousas, Louisiana, in June, 1815.(24)
