Jun 13, 1722 from Robert Middleton of CC, to Alex Magruder of Prince Georges County, for 36 £ sterling, 180 acres of land [which, on] Nov 28, 1717 [was] then laid out at the request of Jno More, executor of the will of John Smith, late decd, of CC, a piece of land for Robt Middelton and Eliza, his wife, pursuant to the sd decd's will, being part of a tract of land in CC called Jordan, which part is bounded by the west side of Zachia Swamp on the north line of the sd John More's land, thence to James Middleton's land being part of the afd tract called Jordan, containing about 180 acres. "This land is part of that 300 acres of land laid out and conveyed by Mr. Robert Hanson by the request of the afd John More, exr of the will of John Smith deceased of CC by the sd 300 acres of land left to the abovesd Robt Middleton's wife Eliza by the sd will". the following deed was recorded this Apr 16, 1729.
Apr 7 1729 from Robert Middleton of CC, Gent, and Elizabt his wife, daughter and heiress to the land and premises hereafter mentioned, of John Smith, late of CC, by his will may more at large appear, to John Ebernethy of CC, innkeeper, for 8000 lbs of tobacco in cask, all that tract of land, messuage, or tenement whereon I now dwell, being part of a larger tract of land granted by will to the sd Elizabeth Middleton by the afd John Smith, containing 300 acres called Jordan, bounded by John Moors land, Zachiah Swamp, containing 300 acres. Sometime heretofore, sd Robert Middleton and Elizabeth, his wife, conveyed to Alexander Magruder of Prince Georges County, Gent, 180 acres out of the afd 300 acres called Jordan. Consequently, there remains unsold about 120 acres of sd tract. Now this deed witnesses that sd Robert Middleton and Elizabeth, his wife, for the afd sum of 8000 lbs of tobacco, have sold to John Ebernethy, sd parcel of about 120 acres called Jordan, now in the actual possession and occupation of sd Robert Middleton, lying on Zachiah Swamp adjoining John Mores land, contiguous to that part of the same heretofore sold by the parties to this deed to Alexander Magruder afd, being in CC.. If sd Robert Middleton and Elizabeth, his wife, do not pay the original sum of 8000 lbs of tobacco with legal interest and other costs and charges in the space of 3 years, to be computed from Mar 1 last past to Mar 1, 1731/2, then in default of such payment, Robert and Elizabeth shall turn out of possession and confess judgement & condenacon of sd land and give an immediate or actual possession of the land and premises, forever barring themselves of the equity of redemption to the sd plantation and premises, without any let, molestation, cost, charges, trouble in the law or otherwise of him, the sd John Ebernethy, by_Robert and Elizabeth or any other persons, provided that if Robert Middleton or Elizabeth, his wife, pay sd John Ebernethy the 8000 lbs of tobacco in cask, being the consideration of sd recited deed, with all costs, charges, and lawful interest thereof, then these presents to be void.
