    On July 25, 1799 a petition was filed with the General Assembly of Tennessee requesting the establishment of a new county to be formed from Sumner County that would be known as Wilson County. 225 men signed the petition, and the last name on the petition is that of John Foster.

    After Wilson County was established on December 23, 1799, Robert Foster, the son of John Foster, was elected its first clerk.

    Robert Foster died in about 1817 and Nancy followed him in death in about 1820. After the death of Nancy, the children were separated and placed in various relatives? homes in Wilson County.

    Because Robert died without a will the Wilson County court directed an inventory be taken of his personal possession. The following list was returned to the courts on January 21, 1818 and can be found on page 305 of Will Book 1814-1819.

    I have included the inventory of his property in order for the reader to get a sense of what items these people possessed.

    Josiah S. McClain, guardian for Isabella Ann Foster, minor heir of Robert Foster, respectfully reports to the worshipful County Court of Wilson, that he received the sum of $474.08 1/4 cents cash paid out of the guardian bond.

    March term 1830
    Pursuant to an order of the court made during the December 1830 term. Josiah L. McClain reports that he sold two Negroes, Jacob & Beck on a 12-month credit (lease) on the 9th day of January last. Said Negroes belonging to the heirs of Robert Foster deceased.

    Jacob is leased to Wm Donald for $350 and Beck to David R. Donald for $160, for a total of $510 given out of my hand.

    In pursuance of an order of the worshipful Court of Pleas & Quarter Sessions of the County of Wilson at September term 1828 appointing as the undersigned commissioners to lay off, divide and apportion the estate which Robert Foster, late of Wilson County dec'd ana....ed amongst his heirs we accordingly, the 25th October 1828, met and proceeded to survey the land claimed by the heirs of the said Robert Foster dec'd and did divide and lay off the same into four tracts as represented by the foregoing plats, distributed and lots as we thought best amongst the heirs taking into consideration their different situations and making:

    Lot No 1, EMSLEY D. FOSTER, which is bounded as follows: beginning at an elm on the southeast corner of Mary Doak's tract she now lives on, and then northeast corner of the tract belonging to the said heirs of Robert Foster dec'd running thence south one hundred and twenty two and one half poles to a white oak the southeast corner of said tract running thence west fifty poles to a white oak in the south boundary of said tract thence north one hundred and twenty two and a-half poles to a stake in Mary Doak's south boundary line running thence east with center line fifty poles to the beginning containing thirty-eight acres.

    Lot No 2, ALBERT FOSTER, and boundary as follows beginning at a white oak the southwest corner of lot number 1, running west seventy five poles a sugartree thence north one hundred and twenty two and one half poles to a stake in said Mary Doak's south boundary line thence east with said line seventy five poles to the northwest corner of the center line thence south with the west boundary line of lot number 1, one hundred and twenty two and one half pole to the beginning containing sixty three and three quarters of an acre.

    Lot No 3, ISABELLA FOSTER, and bounded as follows, beginning at the sugartree the southwest corner of lot number 2, running thence west one hundred and twenty six poles to the southwest corner of the said tract to a stake in Bingham's east boundary thence north with said Bingham's line one hundred and ten poles to a stake in said Bingham's northeast corner thence west with his north boundary eight poles to a stake thence north ten poles to a stake in said Mary Doak's southwest corner thence east one hundred and thirty six poles to the northwest corner of lot number 3, thence sough with the west boundary of said lot one hundred and twenty two poles & 1/2 to the beginning containing ninety six and one-half acres.

    Lot No 4, WILLIAM R. FOSTER, and bounded as follows, beginning at an ash and hackberry marked "R.F.", a line forth six poles west of the northeast corner of a six hundred and forth are tract originally in the name of John Foster and in his north boundary running thence west with the said line eighty four poles crossing a west fork of Spring Creek in all one hundred and eight poles to a white oak thence north fifty four poles to two ironwoods in Robert Foster's south boundary line thence east with the said line seventy poles crossing said west fork of Spring Creek in all one hundred and eighteen poles to an elm thence sough fifty four poles to the beginning containing forty acres.

    On May 29, 1829, fully 10 years after Nancy died that the estate of Robert and Nancy Foster was finally settled. The proceeds were then distributed among their children according to the following.

    We, Sam'l Cannon, Edward Harris and William Donnell having been appointed at the December Term of the County Court for Wilson County Commissioners to settle with James Foster and Alexander Foster administration on the estate of Robt Foster dec'd and also with the same administrators on the estate of Nancy Foster dec'd, have this day convened for that purpose and have examined all the papers pertaining to the said estate as exhibited to us by the said administrators do make the following report, viz --- ...

    Died:
    Although the death dates for Robert or Nancy Foster are uncertain, numerous documents can be found in the Wilson County courthouse concerning their deaths.

    They both died without wills, and their estates were settled in the courts. It took almost 10 years before things to be settled and the property to be divided among their children.

    "My father, Grandfather Foster, Alexander Foster, and Mr. Donnell's father all bought land previous to their leaving
    North Carolina, on Spring Creek, which was then a part of Sumner County. The tract purchased contained twelve hundred and eighty acres. None of the parties had seen the land; and to prevent difficulty in assigning to each one his portion, after personal examination, it was mutually agreed that the decision should be made before the families reached Tennessee. On seeing the land, each member of the company took possession of his own without a murmur, though the poorest part of the tract fell to the share of William Donnell."

    I am in receipt of yours of the 24th January last in which you speak of a former Communication which I have never received but I suppose it was in answer to my first transmitting the Power of att of Martha Foster and
    Mary Doak in which I requested you to acknowledge the receipt of said Power of Att and whether you accepted the appointment or not. I infer from what you say in your last that you have accepted. You state that you cannot get a hearing unless you can get the names of those entitled to distribution in the estate of the Decd Roddy Doak. to this
    end I have taken some pains to learn their names but cannot get all their names (that is) the names of those to whom some of the girls are married, but I will give you the best account that I have been able to get but the where abouts of a good many of them I am not able to give.

    John Doak [b Jan 1773] was the eldest brother who is dead.
    His heirs are the heirs of Benjamin T [or L or S] Mottley Decd who married the only daughter [Martha b 1795] of John Doak. Mrs. Mottley and her Mother are both dead.

    The names of Mottleys (Martha Doak, heirs who are entitled to one half of John Doaks interest I am not able to give entire if it is necessary that they should be known by name that you can get by writing to John F [Foster] Doak who is the brother of Mrs. Mottley & who lives in Wilson Co Tenn. address him at Lebanon Tenn.     The forgoing I believe comprises the information sought for as near as I am able to give it - Perhaps the interest of Martha Foster & Mary Doak could be sold in anticipation of a decree of sale if so will you (if you can learn what can be had for it) write what can be had for it - or what you think would best for them to do, to wait a final decree & sale or dispose of their interest.

    "Westward the course of empire takes its way"

    The first settlers of this county were emigrants chiefly from North Carolina, Virginia, South Carolina and East Tennessee, with a few from Georgia, Maryland and perhaps other States. For much of our information in the respect, we are indebted to a number of the old citizens, surviving children of pioneers, and to whom we hereby make our acknowledgments. Among these are Levi Holloway, James Clemmons, Mrs. Martha Ozment, Mrs. Byrd Smith, Joseph Williams, Edward G. Jacobs, Turner Waters, John T. Goodall, John Palmer, John Perkins, Paulding Anderson, Mrs. Edward Freeman, Tom Alexander, Stephen Woodrum, Lindsay Martin, and John F. Doak, a staunch old Democrat, whose regard for fine horses is only excelled by his admiration for President Jackson, Polk and Johnson, and whose great ambition is to die as he has lived sober and solvent!

    Pioneer Settlers

    The next settlement, it is thought, was made on the waters of Spring creek, about eight miles south from the site of Lebanon, about the year 1796, by John Foster, John Doak, David McGathey, Alexander Braden, and the Donnell families. It was known as the "Donnell Settlement," they having numerical ascendency.

    First Mills, School, Church, Cotton Gin, Etc.

    The first horse mill in the county was built in "the Donnell Settlement," eight miles south of the site of Lebanon, near Doak's Cross Roads about the year 1798. The miller was a stout youth by the name of Robert Donnell; since well known to the public as Rev. Robert Donnell, a prominent minister of the Cumberland Presbyterian Church.

    Organization of the County

    The following named gentlemen were commissioned magistrates,
    to-wit: Charles Kavanaugh, John Alcorn, John Lancaster, Elmore Douglas, John Doak, Matthew Figures, Henry Ross, William Gray, Andrew Donelson and William McClain. Charles Kavanaugh was elected chairman; Robert Foster, clerk; Samuel
    Roseborough, Sheriff; John Alcorn, register; John W. Peyton, trustee; William Gray, ranger; Henry Ross, coroner; and William Quesenberry, surveyor. Benjamin Seawell, Esq., was elected the county solicitor.

    County Seat

    Lebanon, the county seat, was founded in 1802. It is situated on the east branch of Barton's creek, six miles south from Cumberland river, about six miles north of the present geographical center of the county, and thirty miles east from Nashville, with which it is connected by the Tennessee & Pacific railroad.

    The commissioners - Christopher Cooper, Alanson Trigg, Matthew Figures, John Harpole and John Doak - assisted by William Quesenbury, the county surveyor, sought to locate the town near the center of the county, but after examining
    several localities decided to locate it where they did on account of the big spring.
    Residence 1879 Wilson County, Tennessee
    The oldest house in the county, so that we have been able to learn, was built by Samuel Wilson Sherrill, on Barton's Creek, near where the Lebanon and Tucker's Gap crosses that stream, two and a half miles south of west from Lebanon. It was built in 1797-98, of hewn cedar logs, the door shutters being made of split boards, and smoothed with the drawing knife, and nailed together with wrought nails made by hands. It is still in use, the door shutters being now eight-two years old, and strong and serviceable if not handsome. The next oldest is one of the buildings occupied by John F. Doak, built by his paternal grandfather [William]in 1800. It is of hewn yellow poplar logs, and is now in an excellent state of preservation. Its present occupant has had it weatherboarded, and otherwise renovated, to make it harmonize with more recent improvements. It is said by some that the old McClain house is the oldest in the county; but I do not know with certainty

    Sir:
    I have the honor to report that since I recd. the Apt as Capt Comp ?B? Mo Mi -- on the 13th Inst from you per hands of Adj?t Gen G A Parsons, I have spent three or four days on the line between this State and Kansas T - - I find along said line nothing of an exciting Nature or any thing that I think would justify me under my instructions to march my Comp on the line ? There is some fears however entertained by a number of men who are farming in thinly settled neighborhoods that a decent will be made on them by the Kansas Banditti-- before any intimation of such a movement could reach them as it appears those thieving bands are frequently organized some twenty or twenty-five miles back from the line and our citizens would not be apprised of their approach until aroused from their beds by an armed force at their doors. Fearing such an attack might be made I will move on the line with my Company in seven or eight days or as soon as I get the necessary arms and accoutrements for my men ? if I find the fears of our citizens along the line continue?and there remain a week or ten days?or longer if there should any thing arise that is threatening?On this matter however I would request some instructions?at an early date as possible.
    I would respectfully suggest to your honor that some
    fifty stand of muskets be turned over to the citizens of West Point in this County to be distributed among the citizens of this place.
    I would further respectfully suggest that arms suitable
    for the mounted force be sent forward soon?as the muskets
    now at this place are not compleat with accoutrements & c
    which fact I suppose Mr. McHenry has apprised you of.
    I made the selection from my company on the 15th Inst of two men (John Weightman & W. L. Meek) for the Secret Service mentioned in your instructions?would have placed but found that I could get the necessary information without the
    additional expense & c.
