    "I was born in the State of North Carolina, Montgomery County. Have no record of my age but am sixty seven years of age. I entered the army of the revolution the 15 October, 1780 as a volunteer for two months under Captain Ebenezer Riggins in the State of North Carolina. Major James Crump commanded the Battalion. We were marched about through the country to guard against the British and Torries from Wilmington, had no battles, was discharged, but received no discharge. I next volunteered with about sixty others under Captain John Cox mounted infantry for sixty days and marched about securing the country in search of parties of Tories and for the purpose of keeping the Tories from rasing in bodied and doing mischef in the upper country, in this and the first campaign there was no army on our part except the company of ranger to which I was attached, and I needed no discharge. I next volunteered in the foot service to go against the British and Torries who had marched to Hillsborough and took the Governor and council prisoner and were taking them to Wilmington. We met with enemy at Lindleys Mill on Haw river North Carolina, commanded by Col. Hecyor McNeil a Tory and Major Fanning, a British officer.

    We got in the bushes on the side of a long hill about fifty yards from the road, as they came along the road, we fired on them and completely routed and defeated and killed their Commander McNeil the Tory, took a good many prisoners and retook our Governor and Council. General Butler was commander in chief on our side and Col. Mayben the commander of the regiment. I was out about one month or six weeks, and as I joined the expedition without any officer I had no
    discharge, but went home immediately after the battle, though no discharge. This happened the fall of Seventeen Hundred Eighty one (1781]

    The next I volunteered under Captain Joseph Parsons of Montgomery County in a troop of mounted rangers. joined no army but ranged in Montgomery County and Moore County against the Torries. We had a battle at Little River with the same major Fanning, British officer commanding Tories. We kept the ground rifles. Eight or ten of the enemy were killed and they killed three of ours and crippled several others. I was discharged by Capt. Parsons, from this service. I have here the discharge. We were out three months. Capt. Parsons then raised a company of volunteer Rangers during the war, mounted men. About July 1782 I
    joined them and we ranged about through Montgomery and Moore Counties to keep the Tories down, for about three months. We took several of the most notorious Tories and had them hung. I was discharged some time after peace was made and no discharges were given."

    The question is - who was the father of Sam & Jim Nichols? They could have been the sons Samuel Frances Nichols 1807 and James Nichols 1811 who belonged to William & Dorcas Nichols, except we know that William & Dorcas were both still alive on the 1850 census of Montgomery County, Arkansas. The story says that the "father" of Sam & Jim died circa 1845 and was the first one buried there. Perhaps the 1845 date is incorrect? I was told that William and Dorca were buried in Shelbyville, Ill., but I find no proof of that either. That person who posted Illinois as their burial spot also indicates a death date of 1845 - again - we know they were both alive in 1850. It's also strange that they had two sons both named Samuel. The 1850 census shows them living near their son Samuel Joseph Nichols who is buried at Mt. Pisgah. Something to think about???

    "Sam lived on the land on which the cemetery is now located."
    Nichols Cemetery.
    When Sam first came to this area, he lived in a log cabin across the road from the cemetery site. The log cabin was later occupied by Negro slaves who are buried in this cemetery. There are no markers for their graves.
    The father of Sam and Jim Nichols was the first person buried in this cemetery. Thelma does not know the father's name, but she believes that he died in 1845.. (see Note below)
    Since the owners of the land had control over who could be buried in this cemetery, the graves of Mowdy, the Greens, and the Negro slaves can be found in the northeast corner..

    There were three Cap Nichols. The older Cap Nichols was the first person to live on the land now joining the cemetery. His loved ones here, so the cemetery was used for the Nichols family after that..

    Sam was the second Nichols to live on this land. It is his grave that has the wooden grave marker with the following inscriptions..

    In Memory of Sam Nichols, W.H.O., Departed this life Nov 30, A15875 (68 years-6 months-14 days).

    Sam made his own monument from cedar, ready to be "put up" when he died. Under the engraving he cut into the wood and made a compartment where he placed his personal and lodge papers. He put screws in the cut-out part and put it back into place. A few years ago the cedar monument began to deteriorate and the edges of the papers were showing. Someone removed them. It is believed that Lewis, the next and last Nichols to live on the home place, had possession of the papers at one time..
    On July 22, 1944, H. L. (Lewis) Nichols made a deed to J.C. Nichols, Allen Nichols, and Sam Raymond Owens, and their successors for the Nichols Cemetery. The deed was recorded by Arthur Means on July 22, 1944, Book 64, Page 479. The Notary Public was W. N. "Nick" Martin..

    As of this writing 8/20/1983, Sam Raymond Owens is the only one of the three named on the deed who is still living..

    Thelma Nichols Owens' grandfather was Anderson Nichols. Her father was Calvin Nichols, her mother was Janie Miller Nichols. Sam Nichols was the father of Cap Nichols who was the father of H. L. "Lewis" Nichols..

    "Ref: Sam and Jim Nichols: I have an old hand written letter from my Grandma Nichols/Janes
    which states Sam and Jim left their parents at Fort Smith, Ark. and went ahead to build a log house for them. The winter was very bad and their Father died at the old fort. When they returned to the Fort they got their mother and went to the home.
    Lennie Lee Nichols born in 1900 died 1997 in Houston, Texas.
    Grandma was very proud of her family and remembered their history. She always enjoyed talking about her family. I got to meet Jessie Nichols and Pinky Wyatt Nichols when I was very young. Doyla R. Janes"

    Notes for Samuel Joseph Nichols: Based on Mrs. Edwin W. Turner genealogy report 28 July 1986:

    Joseph and Sarah (Richardson) were both born in Alabama, they were married in Alabama, and their first two children were born in Alabama. Their third child was born in Mississippi, their fourth child through 11th child were all born in Arkansas. Their last child was born in Illinois. At about 1845, Joseph and Sarah moved from Mississippi (where Lavina Jane was born) to Mountain Township, Montgomery County, Arkansas.

    On the 1850 Federal Census, which was made 1850 November 2, Joseph and Sarah Nichols lived in Mountain Township, Montgomery County, Arkansas and they had five children. Joseph Nichols was on the Personal Property Tax List through 1853 in Montgomery County. The area that was then Mountain Township, Montgomery County, Arkansas is in present day Garland County, Arkansas. The major portion of what was then Mountain Township is now inundated by 48,000 acre Lake Oachita, which was formed in 1955 by construction of Blakely Mountain Dam across the Oachita River. Lake Oachita stretches 52 miles, spanning sizeable portions of both Garland and Montgomery Counties in West Central Arkansas.

    1857, July 2, Joseph Nichols was the ORIGINAL purchaser of 320 acres of land in Hempstead County, Arkansas. To wit: All land i Township 9 South, Range 25 West, S 1/2 of SE1/4 - Section 7 - 80 acres, 12 and 1/2 cents per acre, $10.00 paid. Residence was located on this parcel: NE1/4 - Section 18 - 160 acres, NW 1/4 of SE1/4 - Section 18 - 40 acres, SE1/4 of NW1/4 - Section 18 - 40 acres, total of 240 acres in Section 18, 12 1/2 cents per acre, $30.00 paid. All 320 acres of his land was purchased from the Federal land Office in Washington, Hempstead County, Arkansas on Original Purchase Certificate number 12165. Joseph Nichols also had SE 1/4 of SW 1/4 - Section 7 - 40 acres, RR selection.

    1858, June 28, Joseph Nichols, signed a Sworn Declaration and Corroborating Affidavit that he had been residing on the above land since 1857, January 1; and that he had erected thereon a dwelling house 18 feet square, a smoke house 12 feet square, and had 10 acres of land in cultivation. Also 1858, June 28, Henry Church and Joshua T. Yarbrough signed a Corroborating Affidavit stating they knew from personal observation that the above statements were true.

    1858, November 12, Joseph and Sarah Nichols, sold to Daniel A. Reeder for $500.00 the following land: The NE1/4 of SW1/4, and SE1/4 of NW1/4, and all that part of the NE1/4 of Section 18, that lies South of the North Fork of Prairie Creek. All land in Township 9 South, Range 25 West, containing in all 185 acres more or less.

    1859, August 19, Samuel Joseph and Sarah Nichols sold to James McCartney for $300.00 the following land: The S1/2 of SE1/4 of Section 7, Township 9 South, Range 25 West, and all of the NE 1/4 of Section 18, lying North of Prairie Creek in Township 9 South, Range 25 West, containing in all 160 acres more or less.

    1860, Joseph Nichols, paid taxes on the following land in Hempstead County, Arkansas: S1/2 of SE1/4 - Section 7 - 80 acres, SW1/4 of SW1/4 - Section 8 - 40 acres, NW1/4 of NW1/4 - Section 17 - 40 acres, N1/2 of NE1/4 - Section 18 - 80 acres. All land in Township 9 South, Range 25 West.

    1860 - in the summer after the Census was made, Joseph Nichols and family moved to Washington Township, Lawrence County, Arkansas approximately 10 miles Southeast of Evening Shade, on Fool Creek. Their Post Office at that time was Evening Shade. They then moved to Jersey County, Ill. around the Fall of 1863 and did not return to Sharp County, Arkansas until November 1868.

    (I believe they moved to Illinois to escape the perils of the Civil War. Story told was that John Taylor Nichols (their Confederate son) returned to Arkansas after the war to help rebuild their home that had been destroyed) (Glenda Nichols)

    Son's William Martin Nichols and John Taylor Nichols, joined the Confederate Forces in the Civil War. Younger son, Samuel James Nichols joined the Union Forces and he settled in Illinois after the war. There is no record of William Martin Nichols after the war and it is believed that he died of wounds. John Taylor Nichols returned to the home in Arkansas and later married and moved to Missouri.

    On the 1880 Federal Census, Joseph and Sarah Nichols, lived in Washington Township, Sharp County, Arkansas.

    Joseph and Sarah Nichols owned 80 acres of land and residence in Big Creek Township, and 140 acres of land and residence in Washington Township, Sharp County, Arkansas. On the 1880 Census, Joseph Nichols' occupation was listed as Farmer/Minister. On some of the Tax Records for Sharp County, Joseph was listed as the Reverand Joseph Nichols. We have been told that Joseph Nichols was a minister of the Church of Christ.

    His Great Grandfather was Edmond Nichols who received a land grand from the King of England in 1758, for Montgomery Co., North Carolina. He was born before 1727 and died before 1800 Census in North Carolina. His Great Grandmother was Mary.
