    In consideration of marriage to be consummated bet. sd. parties, the sd. Samuel agrees as follows:
    1st. Denies for himself and hrs. any rights or interest to any pt. of personal estate of sd. Judith, and gives his free consent for sd. Judith to dispose of personal estate poss. by her before marriage to her child. as to her shall seem fit.
    2nd. Should sd. Judith survive him, the sd. Samuel agrees that she shall poss. his entirepersonal estate during her lifetime, relinquishing for herself and hrs. all interest in his real estate, excepting a certain rent to be pd. to her annually during her widowhood. The afsd. Wilkinson gives bond for £500, dated 19th June, 1713, to Thomas Swan., carpenter, of Charles Co. trustee of Judith Swann, of Saint Mary's Co., widow of Capt. James Swann, of sd. co., dec'd.

    From Sarah Browder: In 1957 Bible in possession of Keith Compton, Clayton, NC, will 1770 St. Mary's Co, MD, another family Bible in poss. of Jane Harrison Clagett; deeded land by father in 1737; on 25 May 1754 Matthew Compton, planter and wife, Rachel, conveyed to MatthewMartain (all of Charles Co) for 7123 pounds of tobacco a portion of tract known as "Gisborough", land passed down to Comptons by Margaret Dent, daughter of Thomas Dent of St. Mary's Co, who married Edmund Howard 26 may 1681, then of Somerset but later of Charles Co; they being grandparents of Rachel Howard Compton, the land lying in Charles Co being 156 acres. On same date, 25 May 1754, Matthew Compton and wife Rachel, for 1898 pounds of tobacco the amount of 50 acres from "Gillsborough", "Gisborough" being 164 acres. [This does seem be referring to Matthew Compton Jr, since in the will of Matthew Compton, 1770, St Mary's Co, he names, among others, his wife Rachel. He left to Barton, Alex. and Edmund H, dwelling plantation of "Wornout", son Stephen a portion of that property, estate divided equally between Matthew, John, Susannah, Barton, Alex., and Edmund H. Witnesses were Robert Slye Wood and Henry Morris and Samuel Briscoe.

    Pursuant to the order of last Aug CC Court, Commission issued on Aug 16, 1740 to Saml Hanson Jr, William Eilbeck, Wm McFerson Sr, Richard Gambra of CC, Gent (not being any way related to the petitioner, contiguous proprietor, nor interested in sd land), to examine witnesses touching the bounds of a tract of land in CC called Guisborough in possession of Matthew Compton Jr.
    And now here, Richard Gambra and William McFerson, return to this Court the Commission with the following certificate & the subsequent deposition -
    We hereby certify that on Mar 30, 1741, we met on the premises within mentioned, and took 1 deposition relating to the bounds of the within land. Signed - Richard Gambra, Will'm McFerson.

    Will dated February 1770, refers to his land called "Worncoat," which he specifically leaves to wife Rachel during her widowhood, leaving his entire estate to her "unless she marry." He provides that the land shall fall to son Stephen if he has heirs; if not, to Matthew if he has heirs; if not, to John, if he has heirs; or to Barton,, or to Alexander, or to Edmund Howard, whichever has heirs. The will shows that of his six children three are under age and neighter of the other three had children at the time of the making of the will. Matthew Compton signed his will in his own hand before witnesses: Robert Slye Wood, Henry Moris, and Saml. Briscoe. The probate was made in St. Mary's Co on the 3rd day of Sep 1770 in the presence of Rachel Compton, the widow, and the three witnesses. No son Zachariah was named in the will.

    The deposition of Henry Haislope, aged 80 years or thereabouts, deposes that about 74-75 years ago, at the spot where this deponent now stands on the east side of Birds Creek Run, stood a mill house belonging to John Perry, and afterwards was owned and possessed by Colo Robert Hanson, who married John Perry's widow. This deponent then removed to the west side of sd run, and about 60 yards to the north of the above named place, and says there stood a waste gate, also says that the run is now in the same place as it was when the mill was standing.     Need to confirm birth date. He was not listed in the Trinity Church records; therefore, possibly was older than Elizabeth and his birth recorded in another parish whose record is no longer extant.
    His will was dated 3 Nov 1784, probated 20 Nov 1784, in Charles Co, Maryland, names his mother Rachel and mentions brothers Matthew, John, Alexander and Edmund. He does not mention Barton who presumably was deceased by that time. Also mentis William and Zachariah as brothers who were not mentioned in his father's will or the Trinity Parish Register. Stephen also named sisters Susanna, Margaret and Elizabeth. In another place he refers to "my niece Ann Compton, daughter of sister Wilder," and to "my nephew Henry T. Compton." He also speaks of "my sister Susanna Swann," and "my three children-in-law, Sarah H. Maddox, Elizabeth J. Maddox, and John Maddox" which he leaves a tract of land called Hanson's Discovery and to John Maddox part of a tract called Bargain. In another place he mentions nephew William S ( or T.) Compton (Liber WB1 folio 421).

    I did a little looking in some of the old Comptonology that I have and found the following.
    In will book 8 page 421, Charles Co., Md. list these children of Mathew and Rachel Compton; Zachariah, Mathew, John, Alexander, Edmund, Howard, Margaret, Elizabeth, Susann md. Turner, William, Wilder, and Stephen.
    Also in another Vol. it list a Dr. Z. J Compton b. 1801, d1866 as the son of E. Howard Compton and Elizabeth Yates.
