    This Indenture Tripartite made the Thirtieth Day of August in the Year of our Lord One Thousand Seven hundred and fifty Between Roger Smith of Charles County in the Province of Maryland Planter and Mary his Wife of the first part Barton Warren of Charles County in the Province aforesaid ^of the second part and Richard Brooke of S.t Marys County in the Province aforesaid^ Planter of the third part Witnesseth that for and in Consideration of the Sum of five Shillings Current Money by him the said Richard Brooke in hand paid to the said Roger Smith and Mary his Wife at or before the ensealing and delivery of these Presents the receipt of which said Sum of five Shillings is hereby respectively Acknowledged and the said Richard Brooke his Executors and Administrators thereof and therefrom for ever by these Presents Acquitted and Discharged And for the Docking Barring and Extinguishing all Estates Tail and all eversions and Remainders thereupon expectant or depending of and in the Lands Tenements and Hereditaments herein after mentioned They the said Roger Smith and Mary his Wife Have Granted Bargained Sold Aliened Released and Confirmed and by these
    Presents Do Grant Bargain Sell Alien Release and Confirm unto the said Richard Brooke (in the Actual Possession of the said Lands Tenements and Hereditaments herein after mentioned now being by Virtue of a Bargain and Sale to him thereof made by the said Roger Smith and Mary his Wife for five Shillings Consideration by Indenture bearing date the day next before the day of the date thereof and by force of the Statute for Transferring Uses into Possession) and to his Heirs All that Tract or Parcel of Plantable Land Situate lying and being in Chaptico in Saint Mary's County afs.d
    called Notley's Addition containing four hundred and fifty Acres of Land more or less with the Appurtenances thereto belonging or in any wise appertaining and the Reversion and Reversions Remainder and Remainders Rents Issues and Profits of the said Lands Tenements and Hereditaments and Premisses with their and every of their Appurtenances and all the Estate Right Title Interest Use Trust Property Possession Claim and Demand whatsoever both at Law and in Equity of him the said Roger Smith and Mary his Wife of in or to the said Lands Tenements Hereditaments and Premisses hereby Granted and Released or mentioned or Intended so to be with their and every of their Appurtenances unto the said Richard Brooke his Heirs and Assigns to and for the Use and behoof of the said Richard Brooke his Heirs and Assigns forever to the Intent and Purpose that he the said Richard Brooke may be perfect Tenant of the Freehold of the said Premisses that a Common Recovery may be had and suffered against him in such manner as is herein after mentioned And for that Purpose it is Covenanted and Agree by and between all other said parties to these Presents that before the end of next September Term or some other ensuing Term at the Costs
    and Charges of the said Roger Smith and Mary his Wife one or more Writ or Writs of Entry Sur Disseisin en le Post shall and may be brought Commenced and Prosecuted out of his Lordships high Court of Chancery returnable and to be returned before his Lordships Justices of the Provincial Court at Annapolis in the Name of the said Barton Warren as Plaintiff for Demandant against the said Richard Brooke as Tenant whereby the said Barton Warren shall demand against the said Richard Brooke the said Lands Tenements Hereditaments and Premisses herein before Granted and released or mentioned or Intended so to be with their and every of their Appurtenances by such Apt and Convenient Names and Descriptions as shall be thought proper to ascertain the same to which Writ the said Richard Brooke
    shall appear Gratis in his own Proper Person or by his Attorney or Attorneys Lawfully Authorized ^and shall Vouch to Warrant the same Premisses the said Roger Smith & Mary his Wife who shall appear Gratis in their own proper Persons or by their Attorney or Attorneys Lawfully Authorized and enter into the said Warranty and Vouch over to Warrant the same Premisses the Common Vouchee of the same Court who shall thereupon appear^ and enter into the said Warranty and after Imparlance make default and depart in Contempt

    The statement by the applicant, that the mother of Elizabeth Warren who married George Scrogin, Jr., was Mary Barton Warren, wife of Thomas, conflicts with another lineage, which states that Thomas Warren was a son of Humphrey Warren, Sr., a merchant who was born in Poynton, England, on 07 July 1632 and died in Charles County, Maryland, in 1673, by his second wife Eleanor. Thomas Warren, who was brought to Maryland in 1663, married (1) Mary Barton on 13 June 1688, daughter of William and Mary Barton, and (2) Jane ------. By his first wife, Mary Barton, Thomas Warren had a son Barton Warren who died on 09 March 1759. By his second wife Jane, Thomas Warren had

On 6/13/1688 her father Wm Barton deeded "Thomas Warren, planter, and Mary, his wife, for natural love for his dau Mary Warren" 148 acres of land, called "Strife" (Deed P:6). Two of their children were named in the will of Mary's father in 1717. Thomas Warren gave a deposition on 9/10/1718, saying he was age 40, so was born in 1678 (Court CL:468). Mary died around 1696. Thomas Warren married secondly Jane____.     Question: Was Mary Barton really 10 years older than Thomas Warren? Elsewhere Thomas Warren's birth was considered to be around 1662.

    According to my records, William Barton mentioned only his grand-daughter,
    Elizabeth Neale and his daughter, Margaret Miller.
    Elizabeth Neale was Elizabeth Hungerford, the offspring of William Barton's daughter Margaret and her first husband, William Hungerford. Elizabeth married John Neale sometime around Nov of 1712. At that time, Elizabeth's brother, Barton Hungerford, for 2 shillings, transferred 28 acres of "Hungerford's Choice" to John Neale. (CCLR Liber D#2, page 33). This John Neale was not John Hanson Neale, but he was probably related as John Hanson Neale and Robert Hanson were the witnesses on this dead. Incidentally, I don't know who John Hanson Neale was, either, and there are several Robert Hansons from which to choose.

    Daughter Margaret Miller was William Barton's daughter, Margaret in a second marriage to Jacob Miller. Jacob died before his inventory was taken sometime during the period March through June 1720. (Both the county and state documents are undated. The entries for Jacob are between entries dated as above.) On 11 Mar 1723/24, Margaret Miller paid 6000 # tob for the purchase of 100 A from Henry Moore for Thomas Morris and Sophia, his wife. (CCLR Liber L#2, page 126) Sophia was most likely her daughter by Jacob Miller--one of the "three youngest children of daughter Margaret"
    mentioned in William Barton's will. On 1 Jan 1732/33, on the eve of the marriage of her son Jacob Miller and Sarah Martin, daughter of John Martin, Margaret conveyed her "entire estate of inheritance" to Jacob, on condition that he maintain her for the rest of her life in the life-style she has enjoyed.
    (CCLR Liber M#2, page 313) On 12 Jun 1733, Margaret Miller recorded a deed of gift whereby she conveyed to her son Barton Hungerford the tracts of land "Capell" and "Barton's Woodyard" deeded to her and her husband, William Hungerford, by her father, William Barton, on 13 Jun 1688.     In the one deposition in 1661, Anne stated 6 or 7 years ago was before she was married. At the same time Humphrey ATTWICKS deposition stated that 4 or 5 years ago he went to demand a bill of Mrs. CAGER by his sister-in-law Anne HUNGERFORD, widow.

    From the first, she was not married before 1654 or 1655. By the second, her husband was dead by 1656 or 1657. As always when dealing with memory, those times may be off a little. I know he was deceased by in 1658.

    William HUNGERFORD could have gone directly from England to MD or he could have been in VA first. If in VA first, at present no one has found a record of it. Hard to say how old he was. As a guess, if he was late teens or early 20s when he first appeared, then he would have been late 20s or early 30s when married.

    Yes, I list Grace BARTON. When I just looked at my page, I noticed I had her under the correct parents (William BARTON and Anne SMOOT) but had a typo in listing her as Grace SMOOT. I have corrected that.

    I notice you list William BARTON who died in 1705 as the one born in 1662. William BARTON Jr. (born ca. 1634) had two sons named William. The first was born in 1662, and the second was born on 27 Feb. 1667/8, he being the one who died in 1705. There is no death record listed for the first William, but he must have died before the second was born. The difference is, that descendants of William III by claiming he was the one born in 1662 have SMOOT ancestry. He was in fact the son of William Jr.'s second wife Mary -?-. Some descendants of William III become upset in losing their SMOOT connection.

    I notice you list that Mary BARTON who married Thomas WARREN was born before 1665, and a child of William BARTON, Jr.'s second wife Mary -?-. Do you have evidence for her birth before 1665, and that she was a child of Mary? I, lean toward the belief she was most likely a daughter of William BARTON, Jr.'s second wife Mary, but can't say so for 100% certain.

    William had a child (unnamed in the record) born 25 Mar. 1667. If that child was Margaret, then Mary was probably born about 1664 or 1665, and could be a child of either Anne SMOOT or Mary -?-. If Mary was the child born in 1667 then Margaret was probably born ca. 1664/5, which would make Mary definitely a child of William BARTON's second wife Mary.

    The difference is again, whether descendants of Thomas WARREN and Mary BARTON are SMOOT descendants or not.

    I find it curious that Ann's father and brother administered the land left to young William Hungerford, born abt. 1657 rather than William Barton to >whom she was married by late 1658. Any comment?

    1. 26 May 1658 there was a patent of 240 acres to William SMOOT.
    2. On 28 May 1658 William SMOOT assigned it to William BARTON, Jr.
    3. 29 June 1662 William BARTON, Jr. has a son William BARTON born.
    4. 1 Oct. 1662 William BARTON, Jr. delivered the patent to his brother-in-law Thomas SMOOTE for the use of William HUNGERFORD, Jr.

    This is my feeling about what was happening, which is the main reason I believe that William BARTON Jr.'s daughter Mary was not a daughter of Anne SMOOT. [Sorry WARREN descendants, if you lose your SMOOT ancestry.] Neither of the deaths of the son William, or of Anne (SMOOT) HUNGERFORD BARTON were recorded. As listed above, the child William born in 1662 was deceased by 1667/8 when the other son William was born, and Anne was deceased by June 1666 (9 months before the child in Mar. 1667 was born). I believe they both died in 1662 between June when the son was born, and Oct. when he transferred the land. At that point, William BARTON, Jr. would have had no living children of his own, no wife, and a step-son William HUNGERFORD about 4 or 5 years old. I believe it is because his wife is deceased, that in Oct. 1662 he transfered the land and guardianship of his step-son William HUNGERFORD to blood relatives. Within the next year or two, William BARTON, Jr. then married Mary!

I connect to both through the marriage of William HUNGERFORD, Jr. (son of William HUNGERFORD, Sr. and Anne SMOOT) to his step-sister Margaret BARTON. I also connect to SMOOT through William SMOOT's son Thomas, and on through several more SMOOT generations. [listed on my page] My grandparents were 9th cousins once removed to each other through SMOOT.
