    Debts include: the inventory of the deed's estate, exhibited this day into Orphan Court, amounting to 784 £ 8 shillings 1 pence; a crop of tobacco left in the deed's house unstripped, inspected in the year 1772. The whole amount: 866 £ 12 shillings 4-1/2 pence.

    The lands of John Warren are in possession of Burford Cottrel, his guardian. We estimate the annual value of sd land as follows - all that part of a tract of land called Frailty, with the following improvements: 1 dwelling house, 16 feet square; addition to ditto, 12 feet square; 1 kitchen, 12 feet square; cellar house, 12 [feet] square; quarter, 20 by 12; cornhouse, 16 by 10; Cheor(?) house, 12 by 8; Dairy, 8 [feet] square; hen house, 12 by 8; tobacco house, 40 by 22 (all which houses want repair) ; 150 apple trees, 250 peach trees, and 2570 panels of fence, which land, we estimate the yearly value at 1500 lbs of tobacco sd guardian is not allowed to clear any of the land except to get what timber the houses may want to repair them, and for firewood, In the forgoing valuation, we have had no regard to sd orphan's report and education, nor to the quit rents of sd land.     John Warren, son of Captain Barton Warren, was born at the ancestral plantation "Frailty" on the Wicomico. His wife was Jane xxxx, who was bequeathed property in the will of Sarah Maddox probated in 1761.

    On November 12, 1760, John Warren with John Marshall was surety for Robert Yates, the administrator of Charles Yates.

    On April 26, 1766, John Warren and Notley Warren were the executors of John Hungerford at which time William Warren and Charles Brandt were their sureties.

    On March 29, 1770, John Warren and John Marshall signed the bond of Jane Hungerford, the executrix of Barton Hungerford.

    The will of John Warren was dated December 21, 1771, and proved in Charles County on November 10, 1773. He named his eldest daughter, Anne Warren, the executrix of his estate and appointed Samuel Love and Stephen Compton as trustees. Anne was bequeathed various negroes and 30 pounds of tobacco "due from my brother William Barton Warren of Virginia". Personalty was bequeathed to the three children; John, Elizabeth, and Eleanor, with the residue of the estate being divided among the four children. Mrs. Small was given the privilege of living at the plantation with the children if she desired.

    The bond of Anne Warren, the executrix, was dated November if, 1773, and placed at £ l,000. Samuel Love and Stephen Compton were the sureties. Her account in September 1775, as Anne Warren was passed by the Deputy Commissary of the court.

    On May 9, 1778, the inventory and final account upon the estate was rendered by Anne Cotterel, formerly Anne Warren and wife of Burford Cotterel as the executrix. Edward Warren and Robert Warren signed the inventory as the next of kin, while Samuel Love and Stephen Comp-ton were the bondsmen. The balance due to heirs was £696/3/7.

    A case before the Chancery Court of Maryland, filed on July 24, 1798, by Zereal Penn and Burford Cotterel, showed that in 1764 John Warren and William Penn, both of Charles County, since deceased, became the sureties for Robert Yates, the administrator of Jonathan Yates, to the value of £1,200. Zereal Penn was the only brother and representative of William Penn who at his death left no issue, and Burford Cotterel was the husband of Anne, the daughter of executor of John Warren, deceased. Robert Yates died without settling the estate of Jonathan Yates, and the said Robert Yates left an only daughter Anne, unmarried, aged 40, deaf, dumb, and non compos mentis.

    "Mary Barton was born around 1668 in Chas Co MD, the dau of Wm Barton and Mary____. She married Thomas Warren, the son of Humphrey Warren, merchant from London, England and his Maryland wife Eleanor___. On 6/13/1688 her father Wm Barton deeded "Thomas Warren, planter, and Mary, his wife, for natural love for his dau Mary Warren" 148 acres of land, called "Strife" (Deed P:6). Two of their children were named in the will of Mary's father in 1717. Thomas Warren gave a deposition on 9/10/1718, saying he was age 40, so was born in 1678 (Court CL:468). Mary died around 1696. Thomas Warren married secondly Jane____.     Question: Was Mary Barton really 10 years older than Thomas Warren? Elsewhere Thomas Warren's birth was considered to be around 1662.

It also proves William and Mary Barton were their parents and their marriage was solemnized before Jun 13, 1688, the date of the deed.     According to my records, William Barton mentioned only his grand-daughter,
    Elizabeth Neale and his daughter, Margaret Miller.
    Elizabeth Neale was Elizabeth Hungerford, the offspring of William Barton's daughter Margaret and her first husband, William Hungerford. Elizabeth married John Neale sometime around Nov of 1712. At that time, Elizabeth's brother, Barton Hungerford, for 2 shillings, transferred 28 acres of "Hungerford's Choice" to John Neale. (CCLR Liber D#2, page 33). This John Neale was not John Hanson Neale, but he was probably related as John Hanson Neale and Robert Hanson were the witnesses on this dead. Incidentally, I don't know who John Hanson Neale was, either, and there are several Robert Hansons from which to choose.

    Daughter Margaret Miller was William Barton's daughter, Margaret in a second marriage to Jacob Miller. Jacob died before his inventory was taken sometime during the period March through June 1720. (Both the county and state documents are undated. The entries for Jacob are between entries dated as above.) On 11 Mar 1723/24, Margaret Miller paid 6000 # tob for the purchase of 100 A from Henry Moore for Thomas Morris and Sophia, his wife. (CCLR Liber L#2, page 126) Sophia was most likely her daughter by Jacob Miller--one of the "three youngest children of daughter Margaret"
    mentioned in William Barton's will. On 1 Jan 1732/33, on the eve of the marriage of her son Jacob Miller and Sarah Martin, daughter of John Martin, Margaret conveyed her "entire estate of inheritance" to Jacob, on condition that he maintain her for the rest of her life in the life-style she has enjoyed.
    (CCLR Liber M#2, page 313) On 12 Jun 1733, Margaret Miller recorded a deed of gift whereby she conveyed to her son Barton Hungerford the tracts of land "Capell" and "Barton's Woodyard" deeded to her and her husband, William Hungerford, by her father, William Barton, on 13 Jun 1688.     William BARTON and Mary had children:
    A child of William Barton (b. ca. 1634), unnamed in the record was born 25 Mar. 1667. This could be either Mary or Margaret. If Margaret was the child born in 1667, then Mary was born between 1662 and 1667 and could be a child of either wife, Anne SMOOT or Mary. If Mary was born in 1667 then Margaret would have been born between 1662-1667. As Margaret married William Hungerford, Jr., a son of Anne Smoot (1st wife of William Barton) by her first husband William Hungerford, Sr., Margaret cannot be a daughter of Anne Smoot, as that would make she and her husband 1/2 brother and sister. Margaret would have been a child William Barton's second marriage to Mary, as would all children born after her.
