J. John Jones Will
Know all men, by these pursuits, that J. John Jones of Smith County, and state of Tennessee, being sick in body, but of sound and disposing mind and memory, and knowing it is appointed for all men, once to die, do make and ordain this my last will and testament as follows,(to wit):
1st: My will is that as soon after my death as may be, all my just debts be paid out of money which may then be in hand and which may then be due me, and should that not be sufficient for the purpose, my negro woman, Sarah, and her child, Rachael, be sold to make up the deficiency, and as it is probable that all this will make an aggregate of more than I owe, in that case, the balance set apart to discharge the contingent expenses of my estate.
2nd: I lend to my beloved wife, Dolly Jones, for her use and comfort during her natural life, the following property, to wit. One hundred acres of land whereon I now live granted to me by the said state of Tennessee by number 3214 and dated the 13 June 1811. With its improvements and emoluments together with part of an other tract joining the one named on the East, as lies Between the East boundery of the first and the small creek running near my dwelling house on the East side, Running down the said creek to the mouth of my __________spring, branch thence a direct course to the nearest point of the East boundary of the tract first named. Also my Negro Woman, Winny, with her two children, Arther and Paul, and also an equal half of all my house hold and kitchen furniture, farming utensils and stock of any kind, all of which she is to possess and use for the purpose above, for and during the time of her natural life.
3rd: My will is that the other half of my household and kitchen furiture, farming utensiles, and stock of any kind
not lent to my wife, as above, be sold in a reasonable credit the proceeds of which I give to my three grand children to wit, Betsy Jones (now by marriage, Betsy Williamson), Lewis Jones, and Armstead Jones, Children of my son, William Jones, dec'd, not allowing any part of my estate to any other members of that family.
4th: I give to my daughter, Betsy Galbreath, my Negro woman, Winny, and her two children, Arther and Paul, with there increase to her and assigns forever, which said negros, she is to ________and possess from and after the death of my said wife, to whom I have lent them during the time of her natural life, also a tract of ten acres of land granted to me adjoining the farm of her husband, William Galbreath on the East which said ten acres she is to possess from and after the death of said wife.
5th: I give to my friend, Cyrus Brevard and William Watts,Guardians in trust, for my daughter, Lucy Dickson, my Negro woman, Milly, and my Negro, Hariott, with their increase, for the use and benefit of my said daughter, Lucy, and also to my said friend, Cyrus and William, guardians in trust, for my daughter, Nancy Ford,my negro woman Suray, and two children, Henderson and Americus, with their increase, for the use and benefit of my said daughter, Nancy, and also to the said, Cyrus Brevard and William Watts, guardians in trust, for my daughter, Alsey Beard, my negro man, Ben, whom they are not to possess until the death of my said wife, having lent him to her during the time of her natural life, and also their guardians, as aforesaid, I give an equal half of a tract of eighty acres of land, which was deeded to me by Stephen Montgomery, which said half is to be taken off the East end or side extending the whole length of the East boundery of said tract, which said several bequeaths to the said Cyrus Brevard and William Watts is to them and their heirs in trust, as above, in full faith and confidence that they will render to my said daughters, Lucy, Nancy, and Alsey,respectfully and regularly, as they may require, all the interest and proceeds of the above bequeaths to them in trust _____to my said daughters, respectfully, in the order and manner above described, making the distinctions as above, without in any wise blending the different bequeaths during the natural lives of my said daughters, Lucy, Nancy,
and Alsey, and at their decease, respectfully, for the parts or portions bequeathed to the said Cyrus and William, for the urpose above, to be equally divided among the children of said daughters, respectfully, to them and their heirs, forever, that is to say, the part bequeathed for the benefit of my daughter, Lucy Dickson, at her decease to be equally divided among her children to them, their heirs and assigns, farever, and the same rules to be observed as to that given in trust for my other daughters, Nancy and Alsey, having the fullest confidence that the said Cyrus and William will faithfully discharge the trust, hereby reposed in them as above.
6th: I give to my Grand Son, Moses Ford, all the balance of a tract of land sold by me to James Lovelady of one hundred
acres, (_____), that part of said tract not sold to said James, say, about twenty or thirty acres, and also a tract
of six acres granted to me by No. 14858 and which joins
the above, to him and his heirs and assigns forever.
7th: To my grandson, William Dickerson, I give a tract of twenty acres of land on the head waters of the little Creek on which I now live, granted to me by No. 14859, to him and his heirs and assigns forever.
8th: To my grandson, Jonas Beard, I give the one equal half of a tract of eighty acres of land, deeded to me by Stephen Montgomery, The other half of said tract, I have by another clause of this will given to Cyrus Brevard and William Watts,as guardians in trust, for my daughter, Alsey Beard.
9th: I give to my grand children, Betsy Jones, now Betsy Williamson, Lewis Jones and Armstead Jones, Children of my son, William Jones, dec'd, in addition to what I have given them by the 3rd clause of this will, an equal half of any and every part of my estate not otherwise disposed of by this will and the other half of which I give to my said wife to be disposed of by her at pleasure.
10th: My will, further, is that, that part of my said estate lent to my wife as by the 2nd clause of this will, except the Negros Therein described, be divided into three equal parts, and which I give to the above Cyrus Brevard and William Watts, guardians in trust, as above, that is to say, two equal parts of the same for the benefit of my daughters, Lucy Dickson and Nancy Ford, in the same way, for the same purposes, and in every manner, managed and finally disposed of, as is provided for in the fifth article of this will, so far as respects, my said two daughters, Lucy and Nancy and the other third part of the same, I give to my daughter, Betsy Galbreath, to her and her heirs and assigns forever.
11th: Whereas, I have in the 5th article of this made a disposition of some of my property of which is in Negros and some of which may eventually fall into the hands of the children of my daughter, Lucy Dickson, and as her son, William Dickson, possesses such a cruel and unreasonable adisposition towards Negros that I should be unwilling for any of those our unfortunate brethern, by my agency, fall into his hands. My will, therefore, is that in event of any of my Negros, by the provisions of this will, have to be divided among the children of her, my daughter, Lucy, that he, William, is to have no share or part of the same, that in lieu of that, I have by the 7th article of this will, a tract of twenty acres of land. My meaning is that it is a share in the Negro part of this estate which may fall to his mother's children, any that he is to have no part of.
12th: Having by the 11th article of this will, given to my grandson, Moses Ford, two small tracts of land which is as good or better than the rest of his mother's children, will respectfully have in the little property which I have provided for them, my will therefore, is that the said Moses has no part or share of such of my estate as may eventually, by the provisions of this will, fall to them. Any of the forgoing parts of this will, to the contrary, not withstanding.
13th: And I do hereby nominate, constitute, and appoint my friends, Brice Martin and Alfred Brevard, my executors, to execute this my last will and testament, Hereby, revoking allothers. In witness whereof, I have hereto set my hand and seal this 22nd July, 1823.
