But if he does not choose to take the above legacy in lieu of any claim he may have against me, then the whole to be sold by my executors, or such part thereof as my be sufficient to satisfy such calim.

    To my three children-in-law, Sarah H. Maddox, Elizabeth J. Maddox and John Maddox I have made deeds of gift to them of sundry Negroes and other chattels recorded in
    CC records, the validity of which deeds are doubtful. I hereby confirm the gifts.
    Immediately after my death, Negro fellow James and my Negro fellow Sam, formerly the property of John Maddox, Senr are to be free. The right of these two Negroes to be in my friends Jonathan Yates and Thomas Harris who no doubt
    will take proper steps to set them free immediately after my death.
    To my mother Rachel Compton one Negro man named Pompey and the use of one Negro girl named Lurana, during her life. And after my and my mother's death, Luraner is to be equally divided amongst the children of my sister, Susana Turner, with her future increase.
    I also give my mother one cow and calf and six sheep
    To Elizabeth Hanson daughter of Walter Hanson one Negro girl called Rachel.
    To my brothers and sisters, viz, Zachariah, Matthew, John, Alexander, Edmund Howard, Margaret, Elizabeth and Susannah the rest of my estate after my just debts and funeral charges are paid to be equally divided between them.

    I did a little looking in some of the old Comptonology that I have and found the following.
    In will book 8 page 421, Charles Co., Md. list these children of Mathew and Rachel Compton; Zachariah, Mathew, John, Alexander, Edmund, Howard, Margaret, Elizabeth, Susann md. Turner, William, Wilder, and Stephen.
    Also in another Vol. it list a Dr. Z. J Compton b. 1801, d1866 as the son of E. Howard Compton and Elizabeth Yates.

    THis wek I came across a artice on the Middleton Family published in the Pennsylvania Genealogiocal Magazine Volume 19 In it it states that James Middleton and sarah Smith had a daughter Mary who married a ___
    Hawkins. The information you sent on the family said Mary Ann married our Ancestor Zachariah Compton. Could this have been a second marriage for Mary? Every thing else fits very nicely so wondered.
    MOre later as I keep digging. Is also some good commenst of the Wheeler and Smith Families in the above articel also

    From Sarah Browder: In 1957 Bible in possession of Keith Compton, Clayton, NC, will 1770 St. Mary's Co, MD, another family Bible in poss. of Jane Harrison Clagett; deeded land by father in 1737; on 25 May 1754 Matthew Compton, planter and wife, Rachel, conveyed to MatthewMartain (all of Charles Co) for 7123 pounds of tobacco a portion of tract known as "Gisborough", land passed down to Comptons by Margaret Dent, daughter of Thomas Dent of St. Mary's Co, who married Edmund Howard 26 may 1681, then of Somerset but later of Charles Co; they being grandparents of Rachel Howard Compton, the land lying in Charles Co being 156 acres. On same date, 25 May 1754, Matthew Compton and wife Rachel, for 1898 pounds of tobacco the amount of 50 acres from "Gillsborough", "Gisborough" being 164 acres. On 1 Dec 1757, Matthew of Charles Co, conveyed to William Compton, planter, for 6000 pounds of tobacco "Wilton" of 149 acres.

    1733, Dec 15: will of William Stevens Howard, planter, Charles County, gave to daughter Rachel, wife of Mathew Compton, personalty. [This does seem be referring to Matthew Compton Jr, since in the will of Matthew Compton, 1770, St Mary's Co, he names, among others, his wife Rachel. He left to Barton, Alex. and Edmund H, dwelling plantation of "Wornout", son Stephen a portion of that property, estate divided equally between Matthew, John, Susannah, Barton, Alex., and Edmund H. Witnesses were Robert Slye Wood and Henry Morris and Samuel Briscoe.

    Pursuant to the order of last Aug CC Court, Commission issued on Aug 16, 1740 to Saml Hanson Jr, William Eilbeck, Wm McFerson Sr, Richard Gambra of CC, Gent (not being any way related to the petitioner, contiguous proprietor, nor interested in sd land), to examine witnesses touching the bounds of a tract of land in CC called Guisborough in possession of Matthew Compton Jr.
    And now here, Richard Gambra and William McFerson, return to this Court the Commission with the following certificate & the subsequent deposition -
    We hereby certify that on Mar 30, 1741, we met on the premises within mentioned, and took 1 deposition relating to the bounds of the within land. Signed - Richard Gambra, Will'm McFerson.

    Will dated February 1770, refers to his land called "Worncoat," which he specifically leaves to wife Rachel during her widowhood, leaving his entire estate to her "unless she marry." He provides that the land shall fall to son Stephen if he has heirs; if not, to Matthew if he has heirs; if not, to John, if he has heirs; or to Barton,, or to Alexander, or to Edmund Howard, whichever has heirs. The will shows that of his six children three are under age and neighter of the other three had children at the time of the making of the will. Matthew Compton signed his will in his own hand before witnesses: Robert Slye Wood, Henry Moris, and Saml. Briscoe. The probate was made in St. Mary's Co on the 3rd day of Sep 1770 in the presence of Rachel Compton, the widow, and the three witnesses. No son Zachariah was named in the will.

    Matthew Compton's will dated Sep 23, 1770, leaves his whole estate to his wife Rachel Compton, "unless she marry."     William Stevens Howard's will 1733: To daughter Rachel wife of Mathew COMPTON personalty. Residue of estate after wife's thirds are deducted, to four young children: viz. William, Elizabeth, Susannah, & Sarah. Test. Benjamin DOUGLASS, Sr. Philip JENKINS, Benjamin DOUGLAS Jr. [L21f55].

    The mother of Rachel Howard needs more investigation. William Stevens' brother Thomas was married to an Elizabeth Douglass. William Stevens' first wife was apparently Elizabeth Douglass. The Elizabeth who was married to Thomas was a widow d was married to Thomas in 1714, so she apparently is not one and the same with the Elizabeth Douglass who was the first wife of William Stevens Howard. Sarah Briscoe's first husband died in 1717, but it's possible they had divorced rather than she being widowed. In William Stevens will he left legacy to 4 young children and Rachel, wife of Mathew Compton. Since Rachel was already married and he had 4 young children, assumption is that Rachel was the child of his first wife.

    Aug 10, 1725 from James Middleton of CC, planter, to James Marr of CC, planter, the lease of part of that tract of land called Jordan, and now in the possession of sd James Middleton, lying on the west side Zachia Swamp below the old usual road that leads from Portobacco [Cr] to the plantation where John Smith at Jordan now dwells, containing about 50 acres. This is a 20 year lease, commencing from Dec 25 last past. The yearly rent is 640 lbs of tobacco. James Marr will build all buildings at his own cost, and is to plant 60 apple trees whenever sd James Middleton shall require them and where he selects on sd plantation, and to be kept well fenced.     1713, May 29. Charles County. Named as a son of John Compton (Campton). John Compton's will was proved Mar 5, 1718. Mathew received one third of his father's real, and one third of his father's personal estate, whereas John's eldest son John received two thirds of the real and personal estate. The real estate lay in both Charles and St. Mary's Counties. No other children were mentioned.

    1721, Nov 20: Matthew Compton was one of the appraisers of the estate of Joseph Peters of St Mary's County.

    1722, Mar 9: Matthew Compton of St Mary's County, planter, divided up with Wm Compton of Chas Co, planter, 2 tracts of land, named Boswell and Booden, with Matthew getting two thirds, and William getting one third. This division was being done to comply with the will of John Compton Sr, deceased, of Charles County. [Suggests that Matthew was now the heir of his uncle John, and that William was closely related. According to Ref: Maryland Deponents, 1634-1799, William was born 1660, making him the same generation as Matthew Sr - possibly a brother]. Ref: Charles County Deed Book L2, p. 78. Also received 140 acres, "Rangle."

    1725: one of the appraisers of the estate of Thomas Morris, St Mary's County.

    1737 Mar 20, son sold Matthew Jr. 90 acres called "Boden" and "Boswell" for 1000 pounds tobacco, included dwelling buildings, barns, stables, garden and orchards.

    1744/5, Mar 19: will of Matthew Compton Sr was written. Names son Samuel (possessed of Matthew's land in VA), daughter Susanna Whitely, daughter Elender Slye, 2 shillings sterling each, grandson Matthew Compton Parker, 2 shillings silver, and son Matthew Compton all the rest of his property. This will was witnessed by George Briscoe and William Howard. The will was proved Sep 15, 1747.
    (Note: Susannah had a bro George who was already deceased at this time. The wit George Briscoe probably a nephew of Susannah, being a son of one of her brothers: John Sr, Philip, Edward, George, or James Briscoe.

    There is in Charles Co. Administrations accounts of Thomas Wakefield which
    includes payment to Matthew Compton.
    MATTHEW COMPTON was born June 17, 1671 and married Susanna Briscoe,
    daughter of Phillip and Susannah (Swann) Briscoe-she being the daughter of Edward
    Swann and wife Susanna and Edward possibly the son of Samuel Swann.

    Edward Swann and John Compton (1-1) received land in same counties and at
    same time for the following parcels of land:
    John Compton and son Matthew both used the Compton family of Northhampton,
    England's seal on documents. The family is in the Earl of Northahmpton and
    listed in Burke's Peerage.

    Mathew and Susanna purchased land called Manchester from Abel Wakefield in
    1705 for 5000 pounds of tobacco, Mathew being listed at that time as a cooper,
    or maker of barrels.
    On 9 March 1722 Mathew received land from his father John. This was his 1/3
    share of 200 acres called Boswell and 80 acres called Boden. By 20 March 1737
    Mathew Sr sold his son Mathew Jr. 90 acres of the Boden and Boswell property
    he had received from his father, inclusing dwellings, out buildings, gardens
    and orchards.

    Mathew Sr wrote his will on 19 March 1744(Charles Co Wills L 25, f 150) and
    it was witnessed by George Briscoe and William Howard. His son Samuel was to
    receive all land he owned in Virginia and 2 shillings sterling, daughters
    Susanna Whitely, Elender Slye-2 shillings each, grandson Mathew Compton Parker 2
    shillings and son Mathew all the rest of his property, both real and personal,
    with son Mathew being executor. Witt: George Briscoe, William Howard The will
    was probated 5 Sept 1747. Liber 25 folio 150 (According to Bible record found
    actual death date was 9 Aug 1747 and wife Susannah died 12 Jan 1739)

    Also, her estimated b.d. is given as 1673, and in some places 1685. Not sure what the books have.

    Further investigation needed to determine if she was in fact the mother of Rachel Howard.

    Unsubstantiated that her father was John Douglass who died 1677/78. If correct, then she had to be older than William Stevens Howard; but ages are reasonable.

Transported to Prince George's Count (then part of Charles County) prior to 1671. Married Mary Wheeler and had 5 sons - three remained Episcopal, as was the father; and two sons became Catholic as was their mother. This accounts for the Middleton's of Charles County being Catholic and the Middleton's of Prince George's County being Episcopal. As a young man about 20, Robert MIDDLETON was transported into Maryland, along with Benjamin ARNOLD and Thomas THORNTON, by Benjamin ROZER, Esq., of Charles County, prior to 2/16/1671. His birthplace has not been determined, but he was born c1651,according to a deposition he filed in August, 1681, stating his age as "about 30 years". In 1672 he married Mary WHEELER, a lass of only 14 and of a prominent Catholic family. Though of a tender age, their happy married life was attested by an issue of five healthy sons. Also he and his wife Mary were given by her father "for fatherly love and natural affections" the plantation "Wheeler's Hope" of 365 acres, lying on a fresh run which emptied into Piscatatway Creek. Besides meeting the challenge of establishing himself on what was then the frontier, he repeatedly evinced a strong will in defending law and order. In1687 through his attorney C. LOMAX he demanded a writ against Richard CLOUDEN in a plea of trespass. He successfully defended himself in a number of other small legal suits. In 1689 he demanded 200 lbs. of tobacco as the price of one wolf's head. Between 1692 and 1707 he shouldered numerous civic responsibilities - jury duty, land boundary commissioner, appraiser, and estate administrator. He was a juror in the Provincial Court in 1680 and 1698. He was appointed a Justice and also coroner for Prince George's County, in 1696, shortly after the founding of that new county. He attested his loyalty to the Crown in 1689 when he signed, with others, the "Address of the Inhabitants of Charles County to their Most Excellent Majesties King William and Queen Mary." He recorded the mark of his cattle in the court term of November, 1704. In 1679 he was one of twelve men of a commission to settle certain property boundaries in the county. He refused to sign the report, which is curious since there was reference there unto Colonel Benjamin ROZER who had brought him into Maryland a few years before. He was a Warden and a Vestryman of St. John's Church of Piscataway Parish at Broad Creek from 1704 to 1708. He died in testate and his administrators Mary MIDDLETON and John MIDDLETON (oldest son) signed the administrative bond on May 6,1708. His third son Thomas was surety for 150 lire sterling since his estate was closed informally, the list of the children cannot be proved complete. Besides the five known sons there may have been daughters, for Benjamin BELT named a son Middleton BELT, and the name MIDDLETON continued in the BELT family for several generations. In 1681 the Council at St. Mary's City commissioned him a cornel in the Mounted Troops under Captain Randolph BRANDT.     The MIDDLETON family history will be started with the birth of a daughter to MAJOR JOHN and MARY WHEELER on March 22, 1658, of Charles County, Maryland. This daughter married ROBERT MIDDLETON about 1672, and thus we find the name MIDDLETON in Maryland for the first time. ROBERT MIDDLETON was born about 1651, but the place of his birth has not yet been established at this time. It is believed he is from Somersetshire, England because correspondence is on file in the Maryland Archives between residents of Charles County, Maryland, and the above-mentioned place in England.
    ROBERT's father in law, MAJOR JOHN WHEELER, gave to he and his wife, MARY, "for fatherly love and natural affections", his 365 acre plantation, "Wheeler's Hope".

    Mary Wheeler was born 22 March 1658 in Charles County, Maryland, the daughter of John and Mary ( ) Wheeler. She married Robert Middleton, by 1673. He was a member of the Church of England, and a member of the vestry of St. John's Parish. She was a Roman Catholic. On 1 July 1681, Robert Middleton was commissioned a Coronet in the Company of captain Randolph Brandt (Archives of Maryland, V. 15, p. 385). On 21 July 1681, he made a deposition stating that he was about 30 years of age. (Arch. of Maryland, V. 15, p. 403). He owned a plantation in Prince George's County, Maryland after that county was formed in 1696. On 20 January 1693 John Wheeler of Charles County, Maryland, gentleman deeded to Robert Middleton "for fatherly love he hath toward Mary the wife of the said Robert Middleton a tract (of land) called Wheeler's Hope, 385 acres..."
