Last Will and Testament of Joseph A. Moyers

I Joseph A Moyers do make and publish this as my last will and testament hereby revoking and making void all others by me at any time made.

First - I direct that my funeral expenses and all my debts be paid as soon after my death as possible out of any moneys that I may die possessed of or may first come into the hands of my Executor.

Secondly - I give and bequeath to Ruth Moyers my wife and to Thompson E. Moyers my son a certain tract of land described as follows.

Lying and being in the 3rd Civil District of Cumberland County and State of Tenn Beginning on a stone being the North Corner of a ten acre tract that I sold to Milton Moyers Thence North to a Hickory Corner in the Phillipsburg land Co. line Thence North with said Phillipsburg line to four sourwoods, Thence South with Apallis Moyers line to a Creek known as Farmers rock house Creek, Thence with said Creek to a Black Gum Corner, Thence South with Thomas Hyders line to a stake Thence West 10 paces to a Double Post oak Corner, Thence South with Thomas Hyders line to a stone Thence West with Milton Moyers line to the Beginning Containing 175 acres more or less.

Thirdly - at the death of Ruth Moyers the said Thompson E Moyers is to have and to hold the said land as described

Fourthly - Ruth Moyers and Thompson E Moyers is to have a house here and to have and to hold all the farming implements, waggon, buggy and Horses

Fifthly - The said Ruth Moyers and Thompson E Moyers is to have my Black Smith and Wood tools.

Sixthly - Ruth Moyers and Thompson E Moyers is to hold and keep as thier own all my stock in herding cattle, sheep, hogs, horses and house hold goods and all debts that are coming to me.

Be it known that I have heretofore given all my other children the amount in money, land and stock, that I intend for them to have the ammount given in land stock and money was to the boys and to the girls sheep, cow each, and household goods.

Lastly - I do hereby nominate and appoint Milton H. Moyers my Executor.

In witness whereof, I do to this my will set my hand this the 8 day of May 1896.

I request that Milton H Moyers also be appointed Guardian of the said Estate.

In the County Court of said County at Crossville Tennessee at the June term 1896 present and presiding J. L. Selby County Chairman This day the within Last will and testament of Joseph A Moyers died was produced in open court and duly and legally proven by the oaths of N. J. Hale and E. N. Hyder the subscribing witnesses to said will who stated that they were present at the time Joseph Moyers signed his name to said will that they signed their names as witnesses thereto at his request that at the time of signing said will the said Testator was of sound and deposing mind and memory.

And the said will being deemed sufficiently proven by said Court it was thereby ordered to be recorded and certified as the law requires.

Written by son John MOYERS: My own dear father's name was James, b in VA abt the yr 1767 27th mar, was of middle stature, heavy built free open countance, very friendly had dark hair, hazel eyes, very expressive. He was a loving husband an affectionate...

Memories 2: parent. He was much given to books, fond of poetry and sacred music, was a sweet singer, and had a goodly share of plain human learning also, he was an upright, honorable professor of the Christian Religion, a member of the Old Presbyterian Church,

Memories 3: fond of the Blessed gospel of the grace of God of it's ministers and Hold Ordiances. His intellect was clear, if not shing, of strong mind and good judgement, was also a good farmer, kept a plentiful tale, and provided well for the wants and education of

Memories 4: his children. he was faithful to keep up prayers in his family while his health would permit. Hekep his bed occasionally near 6 yrs and had to struggle w/a disease of the kidneys and bladder, together w/a general consumption of the nervous system.

Memories 5: Died at last in his old Mansion House, on the banks of Long Creek, in Jefferson County, TN in his 71 yrs and lies buried on the hill that fronts his door beside sister Grissey and our 2 children, Malinda M. and James MYERS on the 18th day of Feb 1838. My mother is yet living
