"And in hopes wounts have to make nary nother one"
State of Tennessee County of Hamilton.
In the name of God - Amen
I Thomas Roberts of Said State & County being of advaced age & knowing that I must shortly die, deem it right & proper that I should make a diposition of the property that I may be possessed of at my death. I therefore make & declare this writing to be & contain my last Will as Testament.
Item 1st - I desire and direct that my body by buried in a decent & Christian like manner, Suitable to my circumstances & condition - My soul I trust will return to God who gave it - as I hope for eternal Salvation through the blessed Lord & Savior Jesus Christ.
Item 2nd - I give & bequeath to my beloved daughter Milly Matilda Roberts, widow of William Roberts deceased during her natural life & to be equally divided at her death amongst all her children, fifty acres of land in the south East corner of the South West fractional quarter of Section Eleven, third fractional Township Forth Range west of the Basis line in Ocoee District including the present residence of SAid Milly Matilda Roberts, Said fifte acres of land bounded on the West by Reuben Wesley Roberts land & on the south by land in possession of John C. Roberts.
Item 3rd - I have heretofore given to John C. Roberts my son, one hundred acres of land, being part of the fractional quarter bequeathed to Milly Matilda Roberts & part sold to my Grandson Reuben Westley Roberts (whom is the son of Milly Matilda Roberts), on certain conditions mentioned in the agreement between my said son John C. and myself which writing is of record: now it is my wish and desire that said John C. shall not inherit or be entitled to any more of my property until all my other heirs have received as much as the said John C. Roberts.
Item 4th - I give and bequeath the remaider of my property except one bedstead and feather bed and furniture which I will bequeath to Milly Matelda Roberts, to the heirs of my Son Reuben Wesley Roberts Deceased & to my two deceased daughters to wit - Tempy Marilda wife of William Lovelady deceased & Cynthia Anna, wife of William Compton Decedased, all residing so far as I know and believe in the State of Arkansas.
Item 5th - I give and bequeath to my daughter Milly Matilda Roberts one bedstead & one feather bed and furniture, in addition to the life time use & enjoyment of fifty Acres of land dequeathed to her in Item Second.
Item 6th - In bequeathing the remainder of my property in Item fourth - I intend what shall be left after the payment of my depts & funeral expenses are paid out of said remainder.
Item 7th - I hereby constitue and appoint my beloved son John C. Roberts, Executor to this my last Will & Testament.
Given under my hand & Seal this 24th day of April 1873. Thos. Roberts (Seal).
Signed, Sealed, published & declared by the said Thomas Roberts as his last Will and Testament in the presence of us the subscrbers, who subscribed our names hereto in the presence of Said Testator & in presence of each other, this 24th day of April, 1873
