    In the name of God amen this day the twenty first of March in the year of our Lord one thousand eight hundred and four I John Doak of the County of Augusta Virginia being weak in body but of perfect mind and memory thanks be to God, calling into mind the mortality of my body and knowing that it is appointed for all men once to die; I do make and ordain this my last Will and Testament Viz principally and first of all I give and recommend my soul to God who gave it, and for my body I recommend it to the earth to be buried in a Christian like and decent manner at the descretion of my Executors and as touching such worldly Estate wherewith it hath pleased God to bless in life, I give devise and dispose of the same in the following manner or form. Item In the first place all my lawfull debts is to be paid, I likewise give and bequeath to my son John Doak one hundred acres of land to be taken off the upper end of the place I now live on, beginning at the foot of the tall hill at David Doaks line and running with the hill to Willsons line likewise a chest with the letters JD. I likewise leave and bequeath to my two sons Samuel Doak and Thomas Mitchell Doak the remainder of the farm I now live on likewise my negro named Fortun and waggon to be equally their own property and if the[y] wish to have the land divided it is to be equally divided as to quantity and quallity with the approbation of my Executors and neither of them is to dispose of his part untill the[y] both agree and sell their parts together. I likewise leave and bequeath to my daughter Nancy Doak one stand of curtains and a bureau. I likewise leave and bequeath to my daughter Rosannah Doak a Bureau. I likewise leave and bequeath to my daughter Betssy Wilson Doak a Bureau, and those Bureaus I have bequeathed to my daughters I do allow them to be levied out of my personal Estate. I likewise leave and bequeath to my daughters the back room of my new house for their private appartment so long as they[y] live single and my two sons Samuel and Thomas possesses this my farm. I leave and bequeath to my son Washington Doak my still and still vessals likewise my largest pair of silver shoe buckles. I leave & bequeath to my son David Doake my lot in Greenville & the best pair of my silver shoe buckles. The rest of my personal Estate not yet mentioned I do allow to be equally divided between my sons and daughters. And I also allow my two sons Samuel and Thomas to maintain my daughters as long as they (my daughters) live single, and I also allow my two sons Washington Doake and David Doak to make this their home and place of residence till Twenty one years of age and that my two sons Samuel Doak and Thomas M Doak shall give them one years schooling of common education and when they[y] arive at the age of Twenty one years said Thomas and Samuel Doak shall give each of them one horse saddle and Bridle, providing any of my sons should decease leaving no lawful issue, their part of the land if not sold shall be equally divided between my surviving sons. And if any of my daughters should decease having no lawfull issue their part shall be equally divided between my surviving daughters. I likewise appoint constitute and ordain my brother Con'l Robert Doak Samuel Doak sen'r and David Doak to be my only and sole executors of this my last will and Testament, and I do hereby disallow revoke and utterly disannul, all former Testaments wills and Executors by me before this time named willed or bequeathed, rytifying and confirming this, and no other to be my last will and Testament. In witness whereof I have hereunto set my hand and seal the day and year above written.

    At a Court held for Augusta County June the 23rd 1806.
    This last Will and Testament of John Doak deceased was proved by the oaths of Samuel Brown, & James Mitchell Jr two of the witnesses thereto & ordered to be recorded and on the motion of Robert Doak, Samuel Doak, & David Doak the Executors therein named, who made oath according to law, and together with William Brown and John Wilson their securities entered into and acknowledged their bond in the penalty of three thousand dollars conditioned as the law directs, Certificate is granted them for obtaining a probat thereof in due form.

Beverley vs. John Doake--Deposition of Thomas Mitchell, 14th October, 1805, aged 73, says: Samuel Doak lived on the land in dispute upwards of sixty years ago and John has lived on it ever since Sam's death. Deposition of Hugh Fulton, 14th October, 1805, aged 77, says: He was acquainted with Samuel, father of John.
