    Hermitage April 20th 1851
    Mr. James Sloan,
    Sir
I am in receipt of yours of the 24th January last in which you speak of a former Communication which I have never received but I suppose it was in answer to my first transmitting the Power of att of Martha Foster and

You state that you cannot get a hearing unless you can get the names of those entitled to distribution in the estate of the Decd Roddy Doak. to this

    [see Alfred H. Foster]

note by Laura: Surely the sisters of John Doak would have remembered their oldest brother's first born son, born before he even left NC, and would have shared this with AH Foster who wrote to the administrator of Roddy Doak's estate on behalf of them.

    Residence:
In 1797, after living for 31 years in North Carolina, John and his family, in company with several of his wife's family, the Donnells, and the families of his sons-in-law, William McClain and John Doak left Guilford County, North Carolina and pioneered to Wilson County, Tennessee. Together with their associates, they achieved the first permanent settlement in Wilson County, which was then part of Sumner County.

Upon their arrival in this area they first settled in an area on the south bank of the Cumberland River in an area referred to as Drake's Lick which was near the mouth of Spencer's Lick Creek. They would later move on to Spring Creek, and it is this area that today is referred to as, "Doak's Crossroads".

    Notes:

Note regarding marital status of Trader William Doak.
William Doak, born 1794 in Guilford County, North Carolina, married Mary Polly McMurray October 16, 1802 in Lincoln County, Tennessee (sic. they're marriage record is in Guildford Co, North Carolina). She passed away on October 26, 1824 after having eight children from this union. Polly was white and had no connection to the Choctaw Indians, nor did the Doak family whose ancestry was Scot.

Sometime between 1807 and 1810 when he started trading with the Choctaw's he took a Choctaw wife, thereby making him a kinsman of the Choctaw' s. This was a very common custom among traders during the period of all southeastern tribes, which is why there are so many English, Scot, Irish and French surnames among the Choctaw, Chickasaw, Creek and Cherokee. To make the situation better, he needed to take the wife of a leader of the Choctaw. According to the research of the late Dr. Edmund King Doak (a descendant of William & Polly) he took a wife who was the daughter of Mingo Apukshunnubbee. Mingo or Mikko in Choctaw is translated King, so Apukshunnubbee was one of the three great Kings of the Choctaw Indians prior to removal from their ancient homeland. With this union, Doak became one, if not t he strongest trader among the Okla Falaya division of the Choctaw Nation. It needs to be noted however, that he was still married to Polly when t his happened. Polygamy was common as the second marriage was under Choctaw law only. From this union, one daughter was born and she was named Sarah Doak.

Around the time of the Treaty of Doak's Stand in 1820 William sent Sarah ( Sally) back to Lincoln County, Tennessee to get an education that was not available to her in that part of Mississippi. This was met with rage by Sallys maternal uncle Pumpkinhead, who threatend to kill William Do ak if he sent his niece away, (a niece who by Choctaw tradition was Pumpki nhead's responsibility). There was another run in between the two men wh en Pumpkinhead learned that Sally had married a whiteman named Thomas Fann ing from Lincoln County. According to Mayme Britt some years ago, a story Dr. Irv May of Texas A & M confirmed in the summer of 1999, the last that was heard from Pumkinhead was around the time that William Doak drown ed in a creek near Doak's Stand. While it was Fall of 1832, it was not believed that the creek was that swollen with Fall rains that William could n ot cross without difficulty. Therefore, the rumor always floated around th at Pumpkinhead actually murdered William Doak and made it look like an acc ident. In any case Pumpkinhead was not seen again in Madison County, Mississippi. JCT 11/2/02

    Property:
Doaks Stand - About 1812 William Doak established his stand, or tavern, on the Natchez Trace which is five miles north of the Parkway at this point. The Treaty of Doaks Stand was signed there in 1820 because, "He conducted himself respectfully toward those who called at his house and made considerable improvement on the land." Doak was given sole right to purchase his land after it was opened for settlement. When the Robinson Road took traffic from the Natchez Trace, the stand was moved to the crossing of the Choctaw Boundary and the new road about 1/2 mile north of here.

    Other-Begin:
The Treaty of Doak's Stand Oct 20, 1820
Doak's Stand [Mile Marker 108] - In 1820, Andrew Jackson met with leaders of the Choctaw Indians at Doak's Tavern, which had been established in 1812 by William Doak. After spending several days trying to convince the Indians to willingly give up their land and move west, Jackson finally threatened to issue an order that would force Indian resettlement. Faced with enforced resettlement, the Indians finally gave up 1/3 of their land, and, on October 20, 1820, signed the Treaty of Doak's Stand. Ten years later, the Choctaws were forced to relinquish the remaining land. [The actual location of Doak's Tavern was west of the present Trace, and is no longer in existance.]

    Other-Begin:
INFORMATION CHANGE {CAUTIONARY NOTE}: The Information linking William Doak to James Wilson Doak & Elizabeth Paisley as his parents is from the inf ormation cited above.* (genealogical chart of 11/3/1988, as provided by the Doak Descendants Search Committee in a gift from Kristen Straight to D r. Edmond Doak). This was not part of my original research. My original research strongly supported that William Doak of Doak's Stand was the son of William Doak and Ann Stuart. This also made him clearly the brother of Josiah, who took over his business with the Choctaw's following his death and later opened Doaksville as a community in the Choctaw Nation, Indian Territory. It is highly unlikely that the Choctaw's would have been so receptive to William's cousin (which Josiah would have been if William was the son of James Wilson Doak). Wiliam, however, was considered a kinsman by the Choctaw due to the wife or concubine he had taken, who was the daughter or niece of Mingo Apukshunnubbee. Therefore, his brother, although having just one wife who was white, would still be accepted. A cous in is doubtful. Recently Robert Oakley has STRONGLY sought to clarify this as well and I believe he is correct. With this in mind and with my having had time to look over the 1988 documents, I am convinced that my origin al information and Robert Oakley's is correct, so I am making corrections to reflect this in the database as of this date. I'm looking for info on Sarah (Sallie) Doak and her father William Paisley Doak. Sarah is the daughter of a Choctaw woman, (name unknown.) She died in 1880 in Grandbury, TX

I believe if you check carefully into documented records, you will find that William Paisley Doak died intestate and without issue, prior to ever taking possession of his share of his father's Revolutionary War grant in Rutherford County, Tennessee. His one-eighth (1/8) share was divided among his seven siblings, as was his share of other lands inherited from hs father in Wilson County, Tennessee. If my research is correct, and William Paisley Doak died intestate, and without issue, that also means he was NOT the William Doak who established Doak's Stand in what is now Madison County (and was originally in Yazoo County) in Mississippi around 1810-1812. I believe if you research the extant primary historical records regarding Doak's Stand, the Treaty of Doak's Stand, etc., etc., you will find references only to "William Doak" and "Wm. Doak," and NEVER a reference to a "Willam Paisley Doak" or a "William P. Doak." I presume you also know that Josiah Doak (also referred to as Jo Doak, and Josiah S. Doak), who was at Doak's Stand with William Doak, and who later was instrumental in the establishment of Doaksville in the Indian Territory in what is now Oklahoma, is commonly referred to--and assumed to have been--the brother of the William Doak at Doak's Stand. If that is the case--and I am convinced that it is--then that is further evidence that William Paisley Doak was not the owner/operator of Doak's Stand, since William Paisley Doak did not have a brother named Josiah. However, Josiah's parents, William and Anne Stuart(?) Doak DID have a son named William (but I've never seen a middle initial or name used for him). Finally, while there is much discussion about William Doak at Doak's Stand having a child named Sally (Sallie) by an Indian woman, I have never seen any documentary evidence supporting such a contention. The William Doak who operated Doak's Stand, and whose first wife Polly McMurry died in Madison County, Mississippi, about 1824, apparently remarried a woman named Sarah Carson. That William Doak died in 1833 in what was then Washington County, Mississippi. A few months later Tallahatchie County, Mississippi, was created, and the administration of William Doak's estate was transferred to that county, where his residence and real property physically were located. Nowhere in the estate proceedings is there ANY mention of a daughter named Sally (Sallie) or who may have been of Indian heritage--which of course doesn't prove that there was not one. But if there was a Sally (Sallie) Doak who had known Indian ancestry through her mother (an Indian princess, I believe the oral tradition suggests?), it is likely that you will have to trace the lineage BACKWARD through Sally (Sallie) to her mother if you are to find documentary evidence to prove your research. Hope this information is helpful.

Letter to James Sloan (located in Guilford Co. NC) from A.H. Foster (located in Hermitage, Hickory Co., MO)
(In a previous letter to Sloan from Foster dated Sept 5, 1850, A.H. Foster has written in the margin that "Martha Foster is my step mother")

    Hermitage April 20th 1851
    Mr. James Sloan,
    Sir

Mary Doak in which I requested you to acknowledge the receipt of said Power of Att and whether you accepted the appointment or not. I infer from what you say in your last that you have accepted. You state that you cannot get a hearing unless you can get the names of those entitled to distribution in the estate of the Decd Roddy Doak. to this
end I have taken some pains to learn their names but cannot get all their names (that is) the names of those to whom some of the girls are married, but I will give you the best account that I have been able to get but the where abouts of a good many of them I am not able to give.

    [see Alfred H. Foster]

note by Laura: Surely the sisters of John Doak would have remembered their oldest brother's first born son, born before he even left NC, and would have shared this with AH Foster who wrote to the administrator of Roddy Doak's estate on behalf of them.

"Josiah took over his (Trader William Doak, Doaks Stand) business with the Choctaw's following his death and later opened Doaksville as a community in the Choctaw Nation, Indian Territory"....
clearly William's brother... "It is highly unlikely that the Choctaw's would have been so receptive to William's cousin (which Josiah would have been if William was the son of James Wilson Doak). Wiliam, however, was considered a kinsman by the Choctaw due to the wife or concubine he had taken, who was the daughter or niece of Mingo Apukshunnubbee. Therefore, his brother, although having just one wife who was white, would still be accepted. A cousin is doubtful."

"Josiah, son of William & Ann and a younger bro of Trader William Doak, is named in his father's will as Josiah (no middle name/initial)
He was also very much involved with the Choctaw.
The Feds paid for him (and family) to accompany the Choctaw on their 'Trail of Tears'
He was 'conductor of the Choctaw delegation' for the Treaty of Dancing Rabbit Creek'
    He (co-)founded Doaksville
He fathered the first white child born in Indian Territory
He was almost certainly Josiah S(tuart) Doak
His son, William H Doak, was a Captain in Clarkson's Battalion during the (un)Civil War - the Union regarded him as one of the two most dangerous men operating in Indian Territory on the Confederate side."

The Nueces County slave records 1846-1854,Vol B, on reel 1012697 indicate that on September 5, 1854 Milford P. Norton obtained a deed of Henry Kinney for a Negro woman whose name cannot be determined on the documents and her son Harrison, both of whom were living with J. S. Doakes (sp) in Nueces County at that time. According to other records, Norton practiced law and later became a Texas state judge in Refugio, TX. Prior to or at the same time of his judicial appointment, he managed the business affairs of Kinney while Kinney was out of the country in Nicaragua. On the same reel, records 4 years later in August and September of 1858 indicate that Kinney did not own the two aforementioned slaves but instead only held them in trust for Josiah Doaks and that Doaks was their legal owner. Therefore they could not be conveyed to Norton. In these documents, it is stated that Doak requested the release from the trust of "the yelllow boy," Harrison, whose mother Susan, was now dead. Norton and Kinney agreed to give up any legal rights to Harrison. A 14 year old Mulatto male is listed on the slave census of 1860 as belonging to J.S. Doak (sp).

It is not known how or why Harrison assumed the surname of Mays.

I just found the Applications for Enrollment of the Commission to the Five Civilized Tribes, 1898-1914 on Footnote and found the application for Josiah Doak's son, Alexander V. Doak. In it some of the questions and answers regarding Josiah Doak are as follows:

Q "When did Jo Doak die?" A "About 1873".

Q "Where did he die, do you know?" A "He died about twelve miles above Corpus Christi."

Q "In Texas?" A "yes sir."

Q "You don't remember exactly the date of his death?" A "No sir."

Q "Is that in any of your papers?" A "No sir."

Q "What was his age when he died?" A "About eighty six."

So now I am convinced that Josiah Doak, father of William H., Malvina Doak (she is mentioned in one of the applications, too), A. V. Doak, Joseph D. Doak and Jonathan Doak, was living in Nueces County, Texas in 1850 and 1860 and probably through to his death around 1873, according to his son Alexander.

    Notes:

"Westward the course of empire takes its way"

The first settlers of this county were emigrants chiefly from North Carolina, Virginia, South Carolina and East Tennessee, with a few from Georgia, Maryland and perhaps other States. For much of our information in the respect, we are indebted to a number of the old citizens, surviving children of pioneers, and to whom we hereby make our acknowledgments. Among these are Levi Holloway, James Clemmons, Mrs. Martha Ozment, Mrs. Byrd Smith, Joseph Williams, Edward G. Jacobs, Turner Waters, John T. Goodall, John Palmer, John Perkins, Paulding Anderson, Mrs. Edward Freeman, Tom Alexander, Stephen Woodrum, Lindsay Martin, and John F. Doak, a staunch old Democrat, whose regard for fine horses is only excelled by his admiration for President Jackson, Polk and Johnson, and whose great ambition is to die as he has lived sober and solvent!

    Pioneer Settlers

The next settlement, it is thought, was made on the waters of Spring creek, about eight miles south from the site of Lebanon, about the year 1796, by John Foster, John Doak, David McGathey, Alexander Braden, and the Donnell families. It was known as the "Donnell Settlement," they having numerical ascendency.

First Mills, School, Church, Cotton Gin, Etc.

The first horse mill in the county was built in "the Donnell Settlement," eight miles south of the site of Lebanon, near Doak's Cross Roads about the year 1798. The miller was a stout youth by the name of Robert Donnell; since well known to the public as Rev. Robert Donnell, a prominent minister of the Cumberland Presbyterian Church.

    Organization of the County

The following named gentlemen were commissioned magistrates,
to-wit: Charles Kavanaugh, John Alcorn, John Lancaster, Elmore Douglas, John Doak, Matthew Figures, Henry Ross, William Gray, Andrew Donelson and William McClain. Charles Kavanaugh was elected chairman; Robert Foster, clerk; Samuel
Roseborough, Sheriff; John Alcorn, register; John W. Peyton, trustee; William Gray, ranger; Henry Ross, coroner; and William Quesenberry, surveyor. Benjamin Seawell, Esq., was elected the county solicitor.

    County Seat

Lebanon, the county seat, was founded in 1802. It is situated on the east branch of Barton's creek, six miles south from Cumberland river, about six miles north of the present geographical center of the county, and thirty miles east from Nashville, with which it is connected by the Tennessee & Pacific railroad.

The commissioners - Christopher Cooper, Alanson Trigg, Matthew Figures, John Harpole and John Doak - assisted by William Quesenbury, the county surveyor, sought to locate the town near the center of the county, but after examining
several localities decided to locate it where they did on account of the big spring.
    Residence 1879 Wilson County, Tennessee
The oldest house in the county, so that we have been able to learn, was built by Samuel Wilson Sherrill, on Barton's Creek, near where the Lebanon and Tucker's Gap crosses that stream, two and a half miles south of west from Lebanon. It was built in 1797-98, of hewn cedar logs, the door shutters being made of split boards, and smoothed with the drawing knife, and nailed together with wrought nails made by hands. It is still in use, the door shutters being now eight-two years old, and strong and serviceable if not handsome. The next oldest is one of the buildings occupied by John F. Doak, built by his paternal grandfather [William]in 1800. It is of hewn yellow poplar logs, and is now in an excellent state of preservation. Its present occupant has had it weatherboarded, and otherwise renovated, to make it harmonize with more recent improvements. It is said by some that the old McClain house is the oldest in the county; but I do not know with certainty

Mr. Doak and James Shaw were the most prominent pioneers of that section. The former was a surveyor for the Austin colony, of which he was one of the leading spirits; platted and staked off the town of Lexington in 1850, out of the James Shaw headright, and purchased 640 acres of that tract adjoining the town, paying $1 per acre. At that time, in 1849, there were not half a dozen families on String Prairie.

Mr. Doak continued to live there until his death, in 1866.

  14. 23.  Sarah "Sally" Doak, (dau?) Descendancy chart to this point (3.William2, 1.William1) was born about 1810 in Madison Co, Mississippi; died in 1880 in Grandbury, Texas.

    Notes:

(see notes of William Doak, her "father"

Sally was 1/2 Choctaw. It is questionable that her parents were actually married. There is some evidence that she was born in Lincoln County, Tennessee, rather than Madison County, Mississippi.
She might be daughter of Tioka "Jane" but story of Tioka might not be confirmed.

    the legend:
Around the time of the Treaty of Doak's Stand in 1820 William sent Sarah ( Sally) back to Lincoln County, Tennessee to get an education that was not available to her in that part of Mississippi. This was met with rage by Sallys maternal uncle Pumpkinhead, who threatend to kill William Doak if he sent his niece away, (a niece who by Choctaw tradition was Pumpkinhead's responsibility). There was another run in between the two men when Pumpkinhead learned that Sally had married a whiteman named Thomas Fanning from Lincoln County.

    the legend refuted:
    ..."

My cousin, Jim Barton, sent me a copy of the proceedings of a hearing by the Department Of The Interior, Commission Of The Five Civilized Tribes, dated December 4, 1906. This was a hearing in which Alexander V. Doak, youngest son of Josiah Doak, was seeking legal membership in the Choctaw tribe. Josiah was made a member of the Choctaw Tribe by Chief Pushmataha. Alexander was granted hearings, but his claims were denied.

Alexander stated that Josiah died in about 1873, twelve miles north of Corpus Christi, Texas. He said that Josiah was about 86 when he died.

Alexander, age 59, said that he was born in Holly Springs, MS. He moved to Doaksville when he was one year old. He lived in Doaksville for about 10 years. He moved with his family to Clarkesville, TX, and lived there about 10 years. He then moved to Fayetteville, AR. He lived there for 5-6 years. He moved to Bates County, Missouri for 4-5 years.

After WWI, he moved to Sherman, TX. He later moved to Dennison, TX, then to Gainsville, then to Dallas. He said he was traveling for Simpson (?) for thirteen years. For the last three years was a government contractor in Ardmore, OK, (1903-1906).

Alexander stated that his father, Josiah, was of Scot decent and spoke with a brogue.

Below is the letter that William H. Doak
sent to R. M. Stewart Comd. In Chf. Mo. Mi.

    ? Head Quarters Mo. Mi.
    Butler, Bates Co., Mo.
    Apl. 21, 1859

    His Excel. R. M. Stewart
    Comd. In Chf. Mo. Mi.

    Sir:
I have the honor to report that since I recd. the Apt as Capt Comp ?B? Mo Mi -- on the 13th Inst from you per hands of Adj?t Gen G A Parsons, I have spent three or four days on the line between this State and Kansas T - - I find along said line nothing of an exciting Nature or any thing that I think would justify me under my instructions to march my Comp on the line ? There is some fears however entertained by a number of men who are farming in thinly settled neighborhoods that a decent will be made on them by the Kansas Banditti-- before any intimation of such a movement could reach them as it appears those thieving bands are frequently organized some twenty or twenty-five miles back from the line and our citizens would not be apprised of their approach until aroused from their beds by an armed force at their doors. Fearing such an attack might be made I will move on the line with my Company in seven or eight days or as soon as I get the necessary arms and accoutrements for my men ? if I find the fears of our citizens along the line continue?and there remain a week or ten days?or longer if there should any thing arise that is threatening? On this matter however I would request some instructions?at an early date as possible.
I would respectfully suggest to your honor that some
fifty stand of muskets be turned over to the citizens of West Point in this County to be distributed among the citizens of this place.
I would further respectfully suggest that arms suitable
for the mounted force be sent forward soon?as the muskets
now at this place are not compleat with accoutrements & c
which fact I suppose Mr. McHenry has apprised you of.
I made the selection from my company on the 15th Inst of two men (John Weightman & W. L. Meek) for the Secret Service mentioned in your instructions?would have placed but found that I could get the necessary information without the
    additional expense & c.
Hoping soon to hear from you I have
    the honor to subscribe myself.
    Yours very Respectfully,
    Wm. H. DOAK
    Capt Co ?B? Mo Mi
