Sep 8, 1770 from Thomas Key of St Mary's County, Gentleman, to Samuel Briscoe of CC, Gentleman, for 611 £ 4 shillings and 6 pence, part of 2 tracts of land in CC, the one called Digges Baltimores Gift, and the other called Digges Addition otherwise called Baltimores Gift Addition, surveyed and taken up by Colo William Digges in about 1682, which same land afterwards became the property of Thomas Perry of Bath Easton in Somersetshire in Great Britain, who by deed conveyed the land to Philip Key, Esq, father of the afd Thomas Key, on about Dec 13, 1737. The land is bounded by the NE corner tree of Mr. Pile's old survey, the head of Stonestreets Gutt, the line of the land formerly belonging to John Berry decd and now in the possession of sd Samuel Briscoe under the sd Thomas Key and called Morrisses Hope or Batchelors Hope, containing about 365 acres, excepting 32 acres part of the land afd and included in sd lines formerly granted on about Mar 10, 1739 by the afd Philip Key to John Briscoe. Also conveyed are 2 parcels of land whereon John Perry, father of the afd Thomas Parry, formerly lived, at the head of Budda Cr in CC, one called Morriss' Hope, originally granted to Richard Morris for 75 acres, the other called Batchelors Hope, originally granted to Robert Page for 50 acres; these last 2 parcels of land adjoin each other, and are contiguous to the 1st afd sold tract. The last 2 tracts were conveyed by sd Thomas Parry to the afd Philip Key on about Dec 13, 1727. Signed - Thos Key, Sam Briscoe. Wit - John Winter*, Robt Horner*. Sep 10, 1782. 1 certify that at the request of Samuel Briscoe, I proceeded to take the following depositions, the parties having been served with 20 days' notice as follows -
CC, Sep 10, 1782, came John Willson Compton before me, a CC JP and made oath that, at the request of Samuel Briscoe, he gave 20 days notice to Doct. John Parnham, Robert Brent Sr, Thomas Ching, Eleanor Slye, Robert Slye, James Chappelear, Richard Carnes, Elizabeth Barber, Edward Wilder, Charles Mills, James Haden, Francis Hamersly, Baptist Barber, William Compton, and Christopher Lemmon, that the sd Samuel Briscoe intended to take the following depositions to prove the possession, tenure, and occupation of certain tracts of land, now in the possession of sd Samuel Briscoe, to wit, Baltimores Gift, Baltimores Gift Addition, Batchelors Hope, and Morrises Hope. Sworn before - Walter Winter.
The Deposition of Henry Haislope, age 76, deposes that 70 years ago, on the east side of Birds Creek Run, stood a mill house belonging to John Perry, and afterwards was owned and possessed by Colo Robert Hanson who married John Perry's widow, and that all the lands from the head of a branch making into the fresh run of Birds Cr to the afd Perry's mill, was owned, peaceably possessed, worked, and enjoyed by John Perry, his widow, and Colo Robert Hanson as far as 'Stonestreets Gut, and that the sd Perry's land joined the lands of John Vaadry and John Slye, and the parcels of the sd lands have been entwat (?) by Perry, his widow, Colo Robert Ranson and their tenants as far back as 60 years (ago). The Deposition of Lancelot Chunn, aged 59, deposes that Elias Darby was tenant to Colo Robert Hanson as this Deponent was informed by sd Darby, and that Darby worked that part of Hanson's land known as Duke's Old Field, and. that Darby lived on sd land 50 years ago or thereabouts. The Deposition of Cornelius Barber, aged 67, deposes that as he walked from where an old mill house, now in the possession of Charles Mills stands to where this Deponent now stands, was the original course of Birds Creek Run, and that the space of ground from the old course of the run to where the present run is, was owned and possessed by John Perry, and that he never understood that sd land was claimed in Perry's time by any other person, and that divers parcels of Colo Robert Hanson's land, which he got by marrying with Perry's widow, were worked by Colo Robert Hanson and his tenants, and that about 60 years ago, Thomas Perry went to England and afterwards sold the land afd to Philip Key, who Negro Quarters on sd land, and cultivated his sd land in diverse places. I certify that, at the request of Samuel Briscoe, I proceeded to take the following depositions, it first appearing by disinterested testimony that the parties interested had been served with legal notice.
Feb 10, 1786. Came Thomas Ching and made oath that at the request of Samuel Briscoe, he gave legal notice to Doc. John Parham, Revd Henry Pile, Robert Brent Sr, Robert Slye, James Hayden, William Compton, William Stephen Compton, Charles Mills, & Mrs. Barbie widow of Baptist, that the sd Samuel Briscoe intended to take the following depositions to prove the possession, occupation, and running of a certain tract of land, now in the possession of him, the sd Samuel Briscoe, to wit, Baltimores Gift, Baltimores Gift Addition, Batchelers Hope, and Morrises Hope. Sworn to before - Bent Dyson.
The deposition of Henry Haislope, aged 80 years or thereabouts, deposes that about 74-75 years ago, at the spot where this deponent now stands on the east side of Birds Creek Run, stood a mill house belonging to John Perry, and afterwards was owned and possessed by Colo Robert Hanson, who married John Perry's widow. This deponent then removed to the west side of sd run, and about 60 yards to the north of the above named place, and says there stood a waste gate, also says that the run is now in the same place as it was when the mill was standing. I, Samuel Briscoe of CC, though weak in body, am of sound and perfect understanding and memory.
To my son William Dent Briscoe - all the lands I shall die possessed of, viz, Morriss' Hope, Bachelors Hope, Baltimores Gift, and Baltimore's Gift Addition,
To my son William Dent Briscoe and to my daughters, Ann Warren Briscoe, Grace Dent Briscoe, Mary Hanson Briscoe, Eleanor Buchanan Briscoe, and Judith Chase Briscoe - the whole of my personal estate, to be equally divided among them, Also, I give my son William Dent Briscoe, Negro wench Suck, as part of his portion of the personal estate. It is my desire that she always live in the house, and so long as my daughters afd, or any one of them, continue in a single state of life, that she, sd Negro Suck, do wait on them or uny one of them, as well as on their Master, Also, I give to my daughters atd, the free and undisturbed use of the dwelling house and houses adjoining, where I now live, so long as any of them remain single, my son William Dent Briscoe supporting them as long as they are single, in a decent, comfortable, and .friendly manner.
